AMENDING AND SUPPLEMENTING THE CODE OF THE BOROUGH OF
CARTERET TO PROIDBIT THE EXPOSURE OF CERTAIN
UNDERGARMENTSWITBITNTHEBOROUGH
WHEREAS, it has been detennined oy'the Mayor and Councit of the Borough of
Carteret that the deliberate exposure of one's underpants, similar lower body
undergarments, and/or parts of one's buttocks, being forced upon the public on public
streets and within public areas is a detrimental to the public good of the community; and
WHEREAS, the Governing Body finds that the same is a detriment to the general
\vetfare, safety, and health of the public.
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Councit of the Borough
of Carteret that the Code of the Borough of Carteret be and is hereby amended and
supplemented to provide as follows:
Section 1. Exposure of Undergarments. It shall be prohibited to
intentionally expose for public viewing any portion of one's
underpants, similar lower body undergarment(s), and/or one's
bare buttocks upon any public street or other public area within
the Borough of Cartere!. The foregoing prohibition shall not
apply to clothing worn as part of any fashion show permitted to
be held within a public area.
. Section 2. Any violation of this ordinance shall be subject to the penalty
provisions of Section 1-17 of this Code.
Section 3. All Ordinances and/or provisions thereof inconsistent with the
provision of this Ordinance shall be and are hereby repealed as to
the extent of any such inconsistencies,
Section 4. If any section, subsection, part, clause or phrase of this Ordinance
shaU be declared invalid by judgment of any Court of competent
jurisdiction, the section, subsection, part, clause or phrase shall
be deemed to be sever able from the remainder of this Ordinance,
Section 5. This Ordinance shall take effect upon passage and publication
according to applicable l~w,
