AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, ACCEPTING AND APPROVING
THE FINAL SUBDIVISION PLAT OF MAGNOLIA PLACE SUBDIVISION, A SUBDIVISION OF
THE CITY OF JEFFERSON, MISSOURI.
WHEREAS, Tom Kauffman, owner of the real estate hereinafter described, having submitted to the
City Council a plat of said real estate, being located in Jefferson City, Cole County, Missouri, and
being part of the south half of Section 17, Township 44 North, Range 11 West, described as
follows: Part of Lots 103 and 108 and all of Lots 104, 105, 106 and 107 of Hedgewood Heights
Subdivision, Block A in the City of Jefferson, Cole County, Missouri, per the plat recorded in Plat
Book 4 Page 72 of the Cole County records, also being part of the tract described by the deed in
Book 320 Page 406 of the Cole County records, being more particularly described as follows:
From the Northwest corner of Lot 3 of One Elm Plaza-Section 2 recorded in Plat Book 11 Page
944 of the Cole County records; thence with the west line of said Lot 3, S20°55'14" W, 72.12 feet,
to the northeast corner of the second tract described by the deed in Book 320 Page 406 of the
Cole County records, said corner also being the POINT OF BEGINNING of this description; thence
from the point of beginning, continuing S20°55'14" W, with the east line of the second and third
tract described by the deed in Book 320 Page 406, also being the Southeasterly boundary of said
Hedgewood Heights Subdivision, 299.00 feet to the northeasterly corner of the tract described by
the deed in Book 569 Page 121 of the Cole County records; thence leaving the east line of said
third tract described by the deed in Book 320 Page 406, N69°03'03" W, with the northerly line of
said tract described by the deed in Book 569 Page 121, 200.41 feet, to a point on the east right-of-
way line of Magnolia Place, also being the Northwest corner of said tract described by the deed in
Book 569 Page 121; thence with the east right-of-way line of Magnolia Place, and the west line of
the second and third tract described by the deed in Book 320 Page 406, N20°55'14" E, 299.00 feet
to the Northwest corner of said second tract described by the deed in Book 320 Page 406; thence
leaving the east right-of-way line of Magnolia Place, and with the north line of said second tract
described by the deed in Book 320 Page 406, S69°03'03" E, 200.41 feet to the POINT OF
BEGINNING and contains 1.38 Acres.
WHEREAS, it appearing that said plat has been fully and properly signed and accepted by
the owner of said subdivision, known and referred to as the Final Subdivision Plat of Magnolia
Place Subdivision, that all taxes have been paid, that in all respects the requirements of Chapter
445, RSMo, entitled "Plats" have been fully complied with by the owner of said subdivision, and
that in all respects the requirements of the Planning and Zoning Commission of the City of
Jefferson, Missouri, relating to plats and subdivisions have been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. That the Final Subdivision Plat of Magnolia Place Subdivision, lying, being,
and situated within the corporate limits of the City of Jefferson, Missouri, as shown by the said plat
attached hereto and made a part of this ordinance, is hereby approved and accepted by the City
Council of the City of Jefferson, Missouri.
SECTION 2. The Mayor and City Clerk are hereby authorized and directed to endorse
acceptance of said plat hereon and to certify the approval of said plat under the seal of the City of
Jefferson.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Case No. P11003 — 800 Block of Magnolia Place; Final Subdivision Plat of Magnolia Place
Subdivision. Application filed by Gary and Janice Sines, property owners, on behalf of Thomas
Kauffman, applicant, for a final plat of 1.38 acres on land zoned RS-3 Medium Density Detached
Residential. This proposed minor plat includes 4 residential lots. The property is located on the
eastern side of Magnolia Place immediately south of Nelson Drive and is described as part of lots
103 and 108 and all of lots 104-107 of Hedgewood Heights Subdivision, Jefferson City, Cole
County, Missouri. (Bartlett and West, Consultant)
Mr. Barron described the proposal and explained this property is currently zoned RS-3 and is
approximately 1.38 acres. He noted this property was platted many years ago and now the owner
would like to re-plat the property into four lots. Mr. Barron explained that there are no new streets
with this plat.
Mr. Tom Kauffman, 252 Kauffman Lane, Bonnots Mill, Missouri, spoke regarding this request and
explained that this land has been for sale for quite some time. He stated that it was originally five
(5) lots and he proposes to break it down into four 75' lots. Mr. Kauffman noted that the two end lots
are buildable at this time but the two middle lots will require fill before they could be built on. He
plans to build residential housing.
No one spoke in opposition to this request.
Mr. Barron gave the Planning Division staff report.
Mr. Wade gave the Engineering Division staff report.
Mr. Nunn moved and Mr. Stacey seconded to recommend approval of the plat as presented,
subject to any staff recommendations or requirements, to the City Council. The motion passed 8-0
with the following votes:

Case No. P11003 — 800 Block of Magnolia Place; Final Subdivision Plat of Magnolia Place
Subdivision. Application filed by Gary and Janice Sines, property owners, on behalf of Thomas Kauffman,

proposed minor plat includes 4 residential lots. The property is located on the eastern side of Magnolia

Background
This Minor Subdivision Plat is proposed in order to replat 4 existing residential lots and 2 partial lots
contained in Hedgewood Heights Subdivision, which was originally platted in 1949, into 4 new residential
lots with wider lot widths.
Description of Proposed Plat
Zoning: RS-3 Medium Density Detached (Single Family) Residential
Size of Property: 138 Acres
Number of Lots: 4 lots
Lot Width: All four lots are shown with a lot width of 74.75 feet, which exceeds the minimum width
requirement of the RS-3 district of 70 feet.
Lot Sizes: All four lots are 034 acres (14,980 square feet), which exceeds the minimum area requirement
of the RS-3 district of 8,000 square feet.
Streets: No streets are proposed with this plat.
Staff Analvsis
All lots shown on the proposed final plat meet the dimensional requirements outlined within the zoning
code and all lots have adequate street frontage and utility access. Several minor technical corrections and
comments on the plat have been transmitted to the consultant. An updated plat with the comments and
technical corrections addressed will be necessary prior to introduction of the final plat to the City Council.
Compliance with the sidewalk requirements of the City Code will also be necessary.
Staff Recommendation
Staff recommends approval of the final subdivision plat subject to the following:
1. Compliance with the sidewalk requirements of the City Code.
2. Compliance with the comments and technical corrections of the Engineering and Planning
Divisions.

Hedgeivood Heights Subdivision, 800 Block of Magnolia Place (RS-3)
ENGINEERING STAFF RECOMMENDATION-
Recommend approval of the subdivision plat, subject to;
1. Sidewalkper City Code requirements.
2. Addition of street lighting along the frontage of the subdivision per City Code
requirements.
3. Ifacation of an existing surface water drainage easement i7ot being utilized in Book 250
Page 870 being along the common property line between Lot 106 and Lot 107.
Infrastructure Summary
* Infrastructure exists in the vicinity.No sidewalk exists along Magnolia Place in from of the
four (4) proposed lots. Storm water detention is not required for this subdivision.
Sanitary sewer exists to serve this property along Magnolia Place.
* A surface water drainage easement exists along the common property line between Lot 106
and Lot 107. No drainage system exists within this easement, and none is planned for the
future. A request has been nsade by the applicant to vacate this surface water drainage
easement. Staff concurs with this request.
Roadwav, Storm Water/Erosion Control
* No planned improvements are necessary for street and public stone sewer improvements.
Storm water detention is not required, as this is considered infill development.
Sanitary Sewer
* The proposed development is served by existing sanitary sewer main along Magnolia
Place. Sewer main extension is not required to serve the proposed lots within the
subdivision. Basements for the proposed homes may have to be pumped to access the
existing main along Magnolia Place.
Sidewalk
* Sidewalk is required in accordance with City Standards along Magnolia Place on the
frontage of the proposed lots. Sidewalk will be needed during construction of homes in
this subdivision.
Street Access / Traffic Impact
Magnolia Place is considered a local roadway. It is a dead-end street with a permanent
cul-de-sac turnaround. It serves a church and other single family residential property.
Fire Hydrants / Street Lights
* Some facilities are existing along Magnolia Place. However, it appears that addition of
street lightiizg along the frorziage of the property will. be necessmy.
