WHEREAS, Paul Sweeney Consultation provides professional services relating to critical review of grants,proposals, funding opportunities, department needs and a management system to support the scope of services available to the City of Opa-locka Police Department; and WHEREAS,Resolution 10-8108,was previously approved for these services to be provided for the benefit of the Police Department; and WHEREAS, the City Commission of the City of Opa-locka desires to approve the Resolution to authorize the City Manager to enter into and execute an Agreement with Paul T. Sweeney; and WHEREAS, the City Commission of the City of Opa-locka,authorizes the City Manager to enter into an Agreement with Paul Sweeney based on an annual term, from January 1, 2011 through December 31,2011,in an amount not to exceed Sixty-Two Thousand Five Hundred Dollars ($62,500): NOW,THEREFORE,BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA: Resolution No. 11-8180 Section 1. The City Commission of the City of Opa-locka hereby authorizes and directs the City Manager to enter into and execute an Agreement with Paul T. Sweeney, (hereinafter referred to as the "Consultant")having its principal office at 14076 S.W. 48th Terrace Miami, FL 33175 and the City of Opa Locka, 780 Fisherman Street N.W., Opa- Locka,Florida 33054 ("City"). A. General Conditions and Stipulations: Consultant agrees to provide consultative and professional services and perform such services according to the following conditions and stipulations: 1. To work under the direction and at the discretion of the Chief of Police or his/her designee. 2. To carry out the tasks, activities, and assignments outlined in the Scope of Services to the extent the constraints of this agreement allow. 3. That modification may be made to the Scope of Services at the discretion of the Chief of Police and agreed to by the Consultant. 4. That the Consultant is an independent individual or organization, not an employee of the Police Department, or the City of Opa Locka, and as such is not entitled to any benefits normally accorded to employees, with the exception that the Department will provide office space or an appropriate work area in the Department facility as may be needed. 5. That any data, studies, reports, grants or other documents prepared or obtained under this agreement shall be considered works for hire and shall become the property of the City without restriction or limitation. 6. The Consultant agrees not to enter into any subcontracts, retain other consultants, or assign, transfer or convey responsibility for any aspect of the work to be completed under the Scope of Services, without prior written consent of the City. 7. To comply with all Federal, State, County and Municipal laws, ordinances, rules and regulations that may pertain to the services provided under this executed agreement. Page 1 of 4 B. Contract period: 1. The contract period shall begin on January 1, 2011 and end on December 31,2011. 2. It is anticipated that the Consultant will commit an average of 10 hours per week during the contract period, but will maintain a reasonable degree of flexibility in scheduling to meet the needs of the Department. However, the total billable hours shall not exceed 1,000 hours. 3. The total dollar value of the contract shall not exceed$62,500. 4. The contract shall expire but may be renewed, extended, or modified prior to the end of the contract period, in whole or in part, with mutual consent of the City and the Consultant in the event the maximum billable hours or total dollar value of the contract has been met. C. Payments to Consultant: 1. Billable hours worked shall be documented by the Consultant on an appropriate invoice, to be approved for payment by the Chief of Police and submitted to the City Manager. 2. Payments may be made in accordance with the City's vendor payment procedures. Payments shall include all hours worked during the reporting period as reflected on the approved invoice. Payment shall be due within 30 days of the date submitted by the Consultant. 3. Payment shall be at the rate of$62.50 per hour. D. Other Expenses for Which the City Shall Reimburse Consultant: 1. Costs for document reproduction, such as grant proposals. 2. Costs for any specialized computer software required by the Department (excluding Microsoft Office products). 3. Actual expenses for travel outside Miami-Dade County required by the Police Department, to include air and/or ground transportation, lodging and the meal allowance rate approved for City employees. Indemnification: Consultant shall indemnify and hold City harmless for any and all actions, claims, injuries or damages resulting from any inappropriate action on the part of the Consultant relating to work performed by Consultant during the period of this contract. F. Scope of Services. Under the direction of the Chief of Police of the Opa Locka Police Department, or his/her designee, the Consultant will conduct the consultative and administrative support activities delineated below. It is understood that changes in focus or shifts in priority regarding the order or urgency of activities to be undertaken are at the discretion of the Department as is necessary to further the mission and goals of the Department as articulated by the Chief and his/her management team. Proposed activities include: • Monitor the police grants management process to track implementation activities to assure that all objectives, administrative reports, invoices, timelines, and deliverables are accomplished in accordance with the deadlines and other requirements of the funding source. • Review relevant websites and other sources to identify potential funding opportunities and advise the Chief of Police accordingly. • Conduct research, outline grant concepts and prepare grants in consultation with the Chief and other staff as appropriate to address police departmental needs regarding personnel, equipment, materials, technologies, training, and community crime prevention enhancements. • At the direction of the Chief of Police, complete grant applications, write grant proposals including narratives, budgets, timelines, implementation plans and other supportive documentation as may be required. • Provide other consultative services or activities as may be requested by the Chief of Police and agreed to by the Consultant.
