Presents the following Ordinance Seconded by Councilman
AMENDING CHAPTER 107 ENTITLED COMMUNITY CENTER
AND CREATING A NEW ARTICLE, ENTITLED
THOMAS J. DEVERIN COMMUNITY CENTER
BE IT ORDAINED by the Mayor and Council of the Borough of Carteret ("Borough")
as follows:
Section 1. The Code ofthe Borough of Carteret is hereby amended and supplemented to
create a new Article in Chapter 107 entitled "Thomas J. Deverin
Community Center" to read as follows:
107-1. Purpose.
The Mayor and Council have detennined that it is advisable to provide for the safe
and orderly use of the Thomas J.-Deverin Community Center by members afthe
public tJlrough the adoption and implementation of reasonable rules and regulations.
107-2. Rules and Regulations.
The Director of the Office on Aging may promulgate and implement mles and
regulations with regard to the reservation and use of the Thomas J. Deverin
COffi1l1unity Center by members of the public.'
107-3. Security deposit fees.
A. Each p'erson wishing to reserve the Thomas J. Deverin Community Center for a
non-Borough sponsored event or program shatt post a $300.00 to a $ t,OOO.OO
apptication fee with the Office on Aging. One hundred dottars ($100.00) of
said fee shall constitute a refundable secmity deposit as provided for therein.
B. The required security deposit shall be refunded upon the determination by the
Director of the Office on Aging, or hislher designee, that the facility is left in a
clean, orderly, and undamaged condition and in full compliance with all
requirements set forth in mles and regulations that may be in effect with regard
to the same.

C. A prorated portion of the security deposit may be retained by the Borough to
Reimburse it for any costs incurred to restore the facility should the same not be
left in a condition in full compliance with the standards set forth in subsection B
above.
D. Each person who reserves the Thomas J. Deverin Community Center for a non-
Borough sponsored event or program shall be responsible for all damages to the
facility resulting from the event or program.
Section 2. All ordinances or parts thereof inconsistent with the provision ofthis
ordinance are hereby repealed limited to the extent of any such inconsistency.
Section 3. If any section, paragraph, sub-division, clause or provision oftrus ordinance is
adjudged invalid, such adjudication shalt appty onty to the section, paragraph,
sub-division, clause or provision so adjudged and the remainder of this
ordinance shall be deemed valid and effective.
Section 4. This ordinance shall take effect upon its passage and publication according
to applicable taw.
