Also that busses waiting to load in front of the hotels will be reminded that they must use their flashers when parked. It was moved by Mr. Krez, seconded by Mr. Taplin and voted that $5,000 should be allocated for a lighting design consultant for Collins Avenue Street lighting and Mr. Maley should get proposals for the next meeting under Competitive Negotiations Act. On motion of Miss Gray, seconded by Mr. Taplin and voted the meeting was adjourned at 11:40-A.M. Attest: Village Clerk i �'(-Y Mayor COUNCIL MINUTES July 29, 1980 August 26, 1980 The council of Bal Harbour Village met Tuesday, August 26, 1980 at 9:30 A.M. in the auditorium of the Church by the Sea. Present: Messrs. Beatty, Krez, and Printup and Miss Gray Absent: Mr. Taplin Also Present were Fred W. Maley, Village Manager; Mary Wetterer, Village Clerk; and Cliff Schulman, representing the Village Attorney. On Motion of Mr. Beatty, seconded by Mr. Krez and voted the minutes of July 29, 1980 were approved as submitted. Ordinance No. 218 correcting an omission in the Zoning Code was read in full by the Village Clerk. On motion of Mr. Krez, seconded by Miss Gray and voted the Ordinance was adopted on second reading. Ordinance No. 219 establishing sewer service charges was read in full by the Village Clerk. On Motion of Mr. Beatty, seconded by Miss Gray and voted the Ordinance was adopted on second reading. The council considered the nine month's operating statements and on motion of Mr. Krez, seconded by Miss Gray and voted the August 26, 1980 statements were filed for audit. The Mayor said he did not have all the information he needed on the alternate savings plan benefit for key em- ployees and asked that it be deferred until the next meet- ing. Mr. Maley explained that proposed Ordinance No. 220 would provide the mechanics for the village to advertise for cable television service. He said that UltraCom Inc. was looking into the cost of installing wire in the village along with the street lighting work and are willing to put in the lines at their risk and expense, before having a franchise with the village. After discussion it was moved by Mr. Beatty, seconded by Miss Gray and voted that UltraCom Inc. be allowed to lay the cable in the residential district after furnishing Bal Harbour with a hold harmless agree- ment stating that they will receive no preferential treat- ment upon application for a village franchise and the cable will be installed at no cost to the village. Mr. Schulman said he would write the agreement. The Village Clerk read Ordinance No. 220, providing for cable television franchises and on motion of Mr. Beatty, seconded by Miss Gray and voted, the ordinance was passed on first reading. Mr. Maley explained the proposed ordinance changing the Village's voting districts. After discussion on the number of representatives on the oceanfront, Mr. Hammer of the Balmoral Apartments asked that the council review the pro- posed plan again before the next meeting. The Village Clerk read Ordinance No. 221 by title and on motion of Miss Gray, seconded by Mr. Beatty and voted the ordinance was adopted on first reading. Mr. Maley explained that the bid opening for additional hydrants for fire flow had been delayed and would be opened next week. He said he preferred not to delay the work until after September council meeting and suggested he be allowed to award the contract if the bids were within 10% of the en- gineers estimate. It was moved by Mr. Beatty, seconded by Miss Gray and voted that Mr. Maley be permitted to sign a contract for the work if the bid is within 10% of our en- gineer's estimate. Mr. Maley said that according to the "TRIM" Tax Act we must notify the county tax assessor by tomorrow of a pro- posed millage rate so that the tax assessor can notify all residents of their proposed tax bills. He requested that the required budget hearings be held September 30 and October 7, 1980 at 5:15 P.M. and reported that under the proposed budget we will need 3.79 mills. It was moved by Mr. Krez, seconded by Mr. Beatty and voted that 3.79 mills be submitted to the Dade County Tax Assessor and that budget hearings be set for September 30th and October 7th. It was the council's decision to hold the regular council meeting at 9:30 A.M. on September 30th. Miss Wetterer, Secretary of the Employees Pension Trust, reported that the Trust has a $130,000 Certificate maturing August 26, 1980 and our advisory committee had recommended the following in- vestments: $50,000 Teledyne Bonds 10.00 of 2004 $25,000 Zapata Bonds 10.25 of 1997 $25,000 MCI stock $30,000 American Electric Power It was moved by Mr. Beatty, seconded by Mr. Krez and voted to make the investments. Mr. Maley said he has learned that private developers have been soliciting endorsements for a children's theme amusement park at Bakers Haulover. He said that from the book of endorsements and park plans that were shown to him, the park would encompass the wilderness area and Par 3 golf course, and he questions the desirability of this lo- cation. Mr. Stanley Whitman said that County Commissioner Ruvin and Park Director Bill Byrd have assured our Resort Advisory Committee that the existing tennis courts will be lighted and improvements made at the golf course and also other recreational activities will be built at Haulover. He feels that this theme park will not be constructed at Bakers Haulover. Mr. Gimel said that the Resort Association does not want it at Bakers Haulover. It was moved by Mr. Krez, seconded by Miss Gray and voted that Bal Harbour go on record against this amusement park and a letter be sent to the Dade County Commission and Park Director stating our position on the matter and that we wish to be notified on any hearings on this matter. Mr. Maley reported that the Umbrella policy we have just purchased brings our liability insurance coverage up to $1,500,000 , not $1,000,000 as previously reported. He also reported that the Balmoral tax case has been assigned to Judge Moie Tenrich and should be heard in October or November. Mr. Maley reported that under the proposed Dade County Special Tax District for fire protection services, to be voted on September 9, 1980, that Bal Harbour, Bay Harbor Islands and Surfside will be paying more than their share of the cost of the County's Fire aid rescue Service, due to our high assessments. He suggested that the mayors and managers of our towns contact the county to do something about tax equity for fire department expenses. The Mayor reported that he had been contacted by the Florida Department of Commerce on behalf of the film in - industry, to see if Bal Harbour would permit movies to be made in Bal Harbour and under what conditions. It was de- cided that it would not be in our best interest to approve this request. August 26, 1980 Chief Staubesand told the council that the sight- seeing companies have been contacted and told to have their busses keep their flashers operating when they are parked on Collins Avenue. He stated that it was difficult to keep the taxis and cars from standing over the side- walk at the Sheraton while waiting for the lights to change. Drivers have been warned and some citations issued. On motion of Mr. Krez, seconded by Mr. Beatty the meeting was adjourned at 11:35. A. M. Present: Miss Gray and Messrs. Beatty, Krez, Printup and Taplin Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney. On motion of Mr. Beatty, seconded by Mr. Krez and voted the minutes of August 26, 1980 were approved as submitted. Mr. Maley explained that Ultra-Com of Dade County, the cable television company that had expressed an interest in laying TV cable in the residential section during our street lighting project, had decided against it. The Village Clerk read Ordinance No. 220, providing for cable television franchises, in full. On motion of Mr. Beatty, seconded by Miss Gray and voted the ordinance was adopted on second reading. Miss Wetterer read Ordinance No. 221 revising the council districts. After discussion from the audience both for and against the proposed ordinance on motion of Mr. Krez, seconded by Miss Gray and voted the ordinance was adopted on second reading. The Village Clerk reviewed the status of accounts at the close of the fiscal year and requested that the council transfer funds between the departments to balance
