Hassett, Constable of the Town of Brewster Greetings: In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of the Town of Brewster qualified to vote in Town affairs to meet in the Brewster Elementary School Auditorium, ?route 6A, Brewster, Massachusetts on Monday, the Seventeenth of November next at Seven-- thirty (7:301) O'clock in the evening, then and there to act on the following Articles: Article 1. To see if the Town will vote to transfer the sum. of Six Hundred Fifty ($650.00) Dollars from revenue Sharing Funds to purchase a legal size four--drawer insulated file cabinet for the Town Archives records storage. Article 2. To see if the Town will vote to have Freeman's Way removed from the list of scenic roads in Brewster, previously voted in Article 96, Annual Town Meeting of MAY 13, 1974, to permit possibility of Mid-Cape, Route 6 access ramps. Article 3. To see if the Town will vote to transfer from Free Cash the sum of Fifteen Hundred ($1,500.00) Dollars to automate. the Torn census, voter regis- tration list and street list of the Town of Brewster. Article 4. To see if the Town will vote to change the designated use of land -.. taken by the Town in Article 17, Annual Town Meeting of March 2, 1970, during which it was designated "for use as a municipal disposal area to the Town of Brewster only", and that it now be designated "to be returned to the Board of Selectmen to be used for municipal economic development.', Article 5. To see if the Town will vote to rescind Article 57, Town Meeting, March 5, 1973 as follows: "To see if the Town will vote to raise and appro- priate by borrowing or otherwise a sum of money for extending water mains not less than six (6) inches but less than sixteen (16) inches in diameter for Sixty-six Hundred (6,600) feet more or less on Matheson Road, Marion Lane, Woodward. Road, Sheep Pond Circle and Woodland Road. (Noted by voice Seventy- one Thousand 071,000.00) Dollars to extend the rain.) Article 6. To see if the Town will vote to rescind Article 58, Town Meeting, PArch 5, 1973 (ratified. in Article 16, Special flown Meeting, May 7, 1973) as follows: "To see if the Town will vote to raise and appropriate by borrowing or otherwise a sum of :coney for extending water rains not less than six (6) inches but less than sixteen (16) inches in diameter for three hundred (300) feet more or less on a private road off Ellis Landing Road. (By Petition) (Voted by voice the sum of Three Thousand Nine Hundred and 00/100 ($3,900.00) Dollars to extend the present water main on Ellis Landing Road westerly along an unnamed private may a distance of about three thousand (3,000) feet using six (6) inch pipe, the property owners guaranteeing the Town ten percent (10%) per year for fifteen (15) years return on the cost thereof. Article 7. To see if the Town will vote to rescind Article 59, Town Meeting, parch 5, 1973 (ratified in Article 18, Special Town Meeting, May 7, 1973) to see if the Town will vote to raise and appropriate by borrowing or otherwise a suis; of money for extending water Trains not less than six (6) inches but less than. sixteen (16) inches in diameter for five hundred seventy (570) feet more or less on Flying NIst Lane. (By Petition) (Voted unanimously that the Town raise and appropriate by borrowing or other- wise the sum of Sixty-two Hundred and 00/100 ($6,200.00) Dollars to extend the present water main on Linnet Road westerly along Flying dist Lane about five hundred seventy (570) feet using six (6) inch pipe, the property owners guaran- teeing the Tcwn ten per cent (10%) per year for fifteen (15) *ears return on the cost thereof. w TT . Article 8. To see if the Town will vote to rescind Article 60, Town Meeting, March 5, 1973 (ratified in Article 18, Special Tower: Meeting, hay 7, 1973) to raise and appropriate by borrowing or otherwise a sum of ?coney for extending water mains not less than six (6) inches but less than sixteen (16) inches in diameter for five thousand seven hundred (5,700) feet more or less on Long Pond ?load, Old long Pond Road, McGuerty Road and Nutley Road. (By Petition) (;,Toted unanimously that the Town raise and appropriate by borrowing or other- wise, the sum of Eighty Thousand Five Hundred and 00/100 ($80,500.00) Dollars to extend the present water main now terminating at the intersection of Long Pond and Greenland Pond Road, McGuerty (toad and ?Nutley Road using six hundred (600) feet of sixteen (16) inch pipe, three thousand five hundred (3,500) feet of twelve (12) -inch, eight hundred (800) feet of eight (8) inch and eight hundred (800) feet of ten (10) inch. The property owners guaranteeing the Town ten per cent (lOw) per year for fifteen (15) years return on the cost thereof. Article 9. To see if the Town will vote to transfer from. Revenue Sharing Funds a sum of money to purchase a portable heart monitor and defibrilator and re- lated rescue equipment. Article 10. To see if the Town will vote to transfer from Available Funds, a sum of money to pay for the professional engineering and appraisal costs for taking, by eminent domain, of land located off Freeman's Way. Said land to be used for proposed recreational use, including construction of a municipal golf course and said funds to be expended under the direction of the Board of Selectmen.. Article 11. To see if the Tower: will vote to authorize the Board of Selectmen to turn over the use of the Brewster Elementary School portable building to the Brewster Council on Aging, for use as a Brewster Council on Aging Center, after the Brewster Elementary School moves into the newly constructed Brewster Elementary School or, or after July 1, 1976. Article 12. To see if the Town will vote to transfer from Free Cash a sum of money to fund Brewster's share of Cape Cod Family and Children's Service, Inc. , for the six (6) month period January 1 through. June 30, 1976. Article 13. To see if the Town will vote to authorize the Board of Selectmen to sell to Brewster Post V.F.W. (Post #'9917) one (1) portable school class- room, located adjacent to the present Brewster Elementary School for the sum of One and 00/100 ($1.00) Dollar. Said sale to be effective on or after July 12 1..976. - Article 11. To see if the Town will vote to transfer from Free Cash the sun of Twelve Hundred and 00/100 ($1,200.00) Dollars to fund Erewster's assessed costs of the operational expenses of the Regional Ffstoric District Commission. (Required by law) . And to authorize the Town Treasurer to may such assessed funds over to the Old ?dings Highway Regional District Commission in accordance Yth Chapter 470 of the Acts of 1973. Article 15. To see if the Towr will vote to transfer from. Free Cash the sum of One Thousand, One Hundred and Thirty-seven and 52/100 ($1,137.52) Dollars to pay the following unpaid bids of fiscal year ended June 30, 1975: Brewster Hardware $ 60.17 Cape Codder, Inc. 29.00 Latanzi & Spaulding 789.86 Douglas Randall 200.00 Ken's Aarket, Inc. 20.00 The Cloth Cottage 9.95 Cape Maid Farms, Inc. 26.85 Western Auto 1.69 11,137- 52 III . Article 16. To see if the Town will vote to authorize the Board of Selectmen to grant an easement to New Bedford Gas and Edison Light Company (Cape & Vine- yard Division) in a strip of land fifteen (15) feet in width extending from the Northwesterly line of Underpass Road, Northwesterly* one thousand, two hundred (1,200) feet more or less for the installation and maintenance of underground electric system and equipment for electric service to the Brewster Elementary School. The lard over which the easement is to be granted is shown in part on plan by Frank Conery, Registered Engineer, dated February, 1975 ar_d recorded in Earnstable County Registry of Deeds in Plan: Book 296, Page 29 and the Elementary School property to the Northwest of the former railroad location and to act fully thereon:. Article 17. To see if the Town w-iII vote to authorize the Board of Selectmen to grant an easement to the New England Telephone and Telegraph Company in a strip of land fifteen, (15) feet in width extending from the Northwesterly line of Underpass Road, ?northwesterly one thousand two hundred (1,200) feet more or less for the installation and maintenance of telephone system and equipment for telephone service to the Brewster Elementary School. The land over which the easement is to be granted is shown in part on plan by Frank Conery, Registered Engineer, dated February, 1975 and recorded in Barnstable County Registry of Deeds in Plan Book 296, Page 29 and the Elementary School property to the North- west of the former railroad location and to act fully thereon. Article 18. To see if the Torre will vote to transfer from Free Cash the sun; of Six Hundred and GO/100 0600.00) Dollars to fund a professional appraisal of about six (6) miles of Penn Central Railroad right-of-way throughout Brewster, as a prerequisite of eventual acquisition of the entire property by the Town. Article 19. To see if the Town will vote to amend the Zoning By-Law, Section V, E, I by eliminating the present Paragraph #1 and substituting the following: 1. No premises in the Town of Brewster shall be used for the parking or storage or occupancy of travel trailers, all types of mobile camping vehicles, or mobile homes, except under the following cir- cumstances: a) A single travel trailer or camping vehicle which may be stored on the premises of a residence but not occupied. b) Camping vehicles or travel trailers may be occupied in com- mercial trailer narks or camps only. Article 20. To see if the Town; will vote to amend the Zoning By-Law, Section II DEFINITIONS by eliminating existing definitions for "Trailer" and "Lodging Unit'' and by adding the following definitions to be inserted in proper alphabetical, order: MILE A dwelling unit built on a chassis and containing electrical., c©'I�Z: plumbing and sanitary facilities, and designed to be installed on a temporary or permanent foundation for permanent living quarters. A TRAVEL A vehicular, portable structure built on a chassis and designed TRAILER: to be used for temporary occupancy for travel, recreation or vacation use, with the manufacturer's permanent identification "Travel Trailer", thereon, and when factory equipped for the road, being of any length provided its gross weight does not exceed forty-five hundred (1500) pounds, or being of any weight provided its overall length does not exceed twenty eight (28) feet. NUBILE Any vehicle or object on wheels which is so designed or con- CAMPING structed or reconstructed or added to by means of accessories, VEHICLE.: to permit the vehicle to travel over the highways and to be used for camping purposes, whether resting on wheels, jacks or other foundation. This definition includes self-powered camping units, expandable camping units, truck mounted campers, vans equipped for camping and similar camping devices. IV. CONAL- A home for the aged, chronically ill, persons requiring care 'SCENT or incurable persons in which three or more persons, not of HOME: the immediate family, are received, kept, or provided with food and shelter or care for compensation; but not including hospitals, clinics or sindlar institutions devoted primarily to the diagnosis and treatment of the sick or injured. LODGING A structure originally designed for single-family use which HOU50 may be converted to provide rooms (not more than 12) for the use of one or more individuals not living as a single house- keeping unit and may provide a common dining facility. It shall include boarding houses, tourist homes and rooming houses, but does not include motels or hotels. NEDICAL A public medical facility devoted to diagnosis and out-patient CENTER OR treatment of the sick or injured. CLINIC: Article 22. To see if the Town will vote to amend the Zoning Ey-Law, Section V, `"able 1, Use Regulations, Retail and Service, Item 10, by eliminating the words SMedical Center or Clinics" and by changing S to P under Chi and CS districts so that item 10 reads as follows: RR RL RM CH CS I "10. Convalescent or Nursing Homes S S S P P X71 Article 23. To see if the Town will vote to amend the Zoning Ry--Law, Section V, Table 1, Use Regulations, Retail and Service, by adding Iter; 25 as follows: RR RL RM CH CS I "25. Medical Center or Clinics S S S P P -ss Article 24. To see if the Town will vote to amend the Zoning Bre-La.°w, Section VI, Table 2, Area Regulations, by adding Note 8 as follows: Intensity of Use Application to Nursing/Convalescent Home. For purposes of interpreting this portion of the Bir-Law, the terra "units shall mean "each bed designed for use by an individual receiving care at such facility". The first three units of a nursing/convalescent home shall rewire a minimum land area equal to the lot requirements for any permitted structure or principal use in the district in which located, with the exception in the CH & CS districts where 20,000 square feet shall be required for the first three units of a nursing/ convalescent horse. In all districts where such use is allowed, including boy Special :permit, each additional "units" shall require a minimum 4,000 square feet of land area. Front, side and rear yard . requirements within the respective districts may be -increased at the discretion of the Board of Appeals if the size of the project, proximity to incompatible adjacent uses or other factors potentially having an adverse affect on the health, safety, or welfare of the persons under care at such facility justifies a more extensive buffer from property lines. The Board of Appeals shall insure that egress from such facility shall be on a street which shall be safe and adequate. Article 25. To see if the Town will vote to amend the Zoning By-Law, Section Vill, Table 4, Off-Street Parking Regulations, by adding the following: "Medical Center or Clinic: 4 spaces per 800 square feet and 1 per each 2 employees". Article 26. To see if the Town will vote to amend the Zoning By-Law, Section V, Table 1, Retail and Service, Iter., 7, "Lodging ?douse" by changing P to S under RL so that Item 7 reads as follows: R-R RL RN CH CS I s'7. Lodging House S 3 S P P W, V. Article 27. To see if the Tow: will vote to change the name of Setucket Road to Satucket Road for its entire length. Article 28. To see if the Town Drill vote to change the name of Route 137 in Brewster, now known as Depot Road and Long pond Road, so that from its inter- section with Route 6A to the Brewster-Harwich line it shall be known as Long Pond Road. Article 29. To see if the Town will vote to change the name of Route 124 in Brewster, now known as Harwich Road and New Count- Road, so that from its in- tersection with Route 61 to the Brewster--Harwich line it shall be known as Harwich Road. Article 30. To see if the Town all vote to instruct the Selectmen to lay out a forty (40) foot wad- from Route #137, along Sheep Pond Drive, along an ancient way bordered by land of Elizabeth Sheehy and Lillian Callahan and Pearl Dickey, along Woodland Road in Sheep pond Estates, Section K and transfer from. Available Funds a sum of money for engineering and appraisal fees connected therewith. Article 31. To see if the Town will vote to change the name of Pond Street to Yassasoit Trail. Article 32. To see if the Town will vote to change the name of Sheep Pond Road, running from Route 124 toward the public landing on Sheep Fond to Fishermens' Landing Road. Article 33. To see if the Town will vote to change the name of Route 39 in Brewster from Brewster-Orleans-Harwich Road, also known as County Highway Route 39, to South Orleans Road. Article 34. To see if the Town will vote to change the name of Crosby Neck Road, that portion raid out as a town road., to Crowall's Bog Road. -- Article 35. To see if the Town will vote to transfer from Available Funds the sum of Three Thousand ($3,000.00} Dollars to provide new street signs for those roads whose names are changed. Article 36. To see if the town will vote to transfer from Available Funds a sum of money sufficient to cover damages and costs for opening the entrance of Millstone Road at Route 6A, to eliminate traffic hazard. Article 37. To see if the Towyn will vote to rescind Article 19 of the Annual Town Meeting, 1964, with respect to the establishment of the position of a Town Archivist and substitute the following Article: "To see if the Town will vote to establish the position of Town Archivist, to be appointed by the Board of Selectmen and operate ander their direction."
