HomeMy Public PortalAbout1988-099CITY OF MEDINA q RESOLUTION NO. 071- I RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO JOSEPH BERTHIAUME, DBA BERTHIAUME COMMERCIAL LAWN & SNOW, INC. WHEREAS, Joseph Berthiaume, dba Berthiaume Commercial Lawn & Snow, Inc. (Applicant) has applied for a conditional use permit for a lawn care and snow removal business at SO& e Af`.f,^ L� , ��� ; and WHEREAS, the city's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on November 9, 1988, and by the City Council on December 6, 1988; and WHEREAS, it has been determined that the existence of a lawn care and snow removal business will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The Applicant shall comply with PCA regulations regarding the underground fuel tanks; 2. Exterior lighting shall be designed and installed so as not to cast light on adjacent properties or roadways and shall be reviewed by the city staff; 3. There shall be a limit of six full-time employees and 20 additional part-time employees during snow removal season; 4. The outdoor speaker shall not be loud enough to broadcast off site; 5. The Applicant may retain the existing outside storage if it is screened or fenced and kept in good repair but no additional storage on the site shall be permitted; 6. Because of the transitional nature of the property, the exterior of the building may remain as is at the present time if maintained in good repair; 7. The existing signage on the site may remain but no additional signs may be added; 8. The screening of the parking area and of the adjacent property is adequate; 9. The trash dumpster shall be screened behind a fence; 10. The loading area shall be within a fence; 11. The existing site landscaping, hard surface coverage, loading area, driveway and parking surfaces are adequate to meet city requirements at the present time; 12. The parking area shall be confined to the commercial parcels, lots 28 and 29; 13. Hours of operation may be 24 hours per day, seven days per week; 14. The Applicant shall dedicate to the city the right-of-way for state highway 101, if city staff determines such to be necessary; 15. A single access from state highway 101 shall be allowed for the entire 3-parcel site; 16. The city shall review the status of the parking and driveway areas and of the metal building three years from the adoption of this resolution and reserves the right to require that the Applicant comply fully with city requirements regarding such matters if deemed in the public interest; 17. The fire department shall review the commercial building for compli- ance with all relevant fire regulations; and 18. The Applicant shall pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this conditional use permit application.
