HomeMy Public PortalAbout1989-03i Member \--5C/ t_6-eAr introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. O - ,3 RESOLUTION GRANTING A VARIANCE TO WAYNE POPHAM AND JOAN POPHAM WHEREAS, Wayne Popham and Joan Popham (Applicants) have requested a variance to reduce the setback from the lake from 400 feet to 150 feet for a house to be constructed on their property at 2725 Hamel Road; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicant's request on December 13, 1988, and recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicants regarding their request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicants' request for a variance to reduce the setback of their house from the lake from 400 feet to 150 feet shall be granted on the grounds that the topography of the property and the uneven shoreline of the lake constitute hardships unique to the property and the fact that the tower is an architectural feature without habitable space. The variance is granted subject to the following conditions: 1 1. The house must be constructed within one year of the date of the adoption of this resolution or the variance hereby approved shall lapse; and 2. The Applicants shall pay to the city a fee to reimburse the city for its expenses in reviewing this variance application. Dated: ATTEST: ctiez�t �jc 17 , 1989 .
