their busses keep their flashers operating when they are
parked on Collins Avenue. He stated that it was difficult
to keep the taxis and cars from standing over the side-
walk at the Sheraton while waiting for the lights to
change. Drivers have been warned and some citations issued.
On motion of Mr. Krez, seconded by Mr. Beatty the
meeting was adjourned at 11:35. A. M.

COUNCIL MINUTES
September 30, 1980
The Council of Bal Harbour met Tuesday, September 30,
1980 at 9:30 A. M. in the Village Hall.
Present: Miss Gray and Messrs. Beatty, Krez, Printup
and Taplin
Also present were Fred W. Maley, Village Manager; Mary
T. Wetterer, Village Clerk; and Alan S. Gold, Village
Attorney.
On motion of Mr. Beatty, seconded by Mr. Krez and voted
the minutes of August 26, 1980 were approved as submitted.
Mr. Maley explained that Ultra-Com of Dade County, the
cable television company that had expressed an interest in
laying TV cable in the residential section during our street
lighting project, had decided against it. The Village Clerk

providing for cable television franchises, in full. On
motion of Mr. Beatty, seconded by Miss Gray and voted the
ordinance was adopted on second reading.
Miss Wetterer read
Ordinance No. 221
revising the council districts. After discussion from the
audience both for and against the proposed ordinance on
motion of Mr. Krez, seconded by Miss Gray and voted the
ordinance was adopted on second reading.
The Village Clerk reviewed the status of accounts
at the close of the fiscal year and requested that the
council transfer funds between the departments to balance
the current budget. It was moved by Mr. Beatty, seconded
by Mr. Krez and voted that funds be transferred between de-
partments.
Mr. Maley explained that due to the purchase of the
computer and the increased cost of the street lighting pro-
ject authorized by the council, expenditures had exceeded
amounts budgeted, although we had collected approximately
$120,000 in additional revenue for the year.
The Village Clerk read
Ordinance No. 222
as an emergency measure transferring $69,850 from Unap-
propriated Surplus to the General Fund Budget. On Motion
of Mr. Taplin, seconded by Miss Gray and voted the ordi-
nance was adopted.
Mr. Maley explained that the bids for the three new
fire hydrants had exceeded the 10°% over estimate he had
been authorized. He said he later received an informal
proposal which was within reason for the work. It was
moved by Mr. Krez, seconded by Miss Gray and voted that
the bids be rejected and the job be rebid.
The Village Clerk read Ordinance No. 223, amending
the Bal Harbour Village Employees Pension Trust for the
first reading. Mr. Maley and Mr. Rizzo, our pension act-
uary, explained the changes in the plan in regard to lower
retirement age for police officers and long term general
employees, the shorter waiting period, and some house-
keeping items to comply with Florida and Federal pension
laws. It was moved by Mr. Taplin, seconded by Miss Gray
and voted that the ordinance be adopted. Mr. Gold said
he would review the ordinance before next meeting.
Mr. Maley reviewed the memo he had sent to the council
regarding an alternate savings plan benefit for key em-
ployees, which suggested a minimum termination benefit until
the vested right in the pension plan amounted to more than
that amount. The plan would be separate from the retire-
ment fund and funded through the general fund. Mr. Rizzo
said their firm had considered this matter but it was one
of many alternatives. It was suggested that Mr. Rizzo re-
view the suggested plan as to costs, eligibility, type of
terminations and vesting.
Mr. Printup said that the Resort Tax Advisory Com-
mittee had discussed changing advertising agencies, but
that they did not have time to interview new agencies.
He recommended that Mr. McCullough's contract be renewed
six months, which would give the committee more time. It
was moved by Mr. Beatty, seconded by Mr. Krez and voted
taht Sam McCullough and Associates be retained for six
months.
Mr. Maley said the Tourism Department has a contract
with Bill Kofoed for public relations and recommended
that his contract be renewed for 12 months. Mr. Taplin said
he would like to see some of Mr. Kofoed's reports. It was

moved by Mr. Taplin, seconded by Miss Gray and voted that
the contract be renewed.
The Village Manager said that Mr. Gold's firm had pre-
pared a new Library Agreement between Bal Harbour, Bay
Harbor Islands and Surfside. He explained that the Agree-
ment sets forth the policy for operation of the library and
the role of the Advisory Committee. It was moved by Miss
Gray, seconded by Mr. Taplin and voted that the Agreement
be presented to the other municipalities for review.
Chief Staubesand explained that the City of North Miami
Beach had obtained a Federal Grant for psychological test-
ing for police officers and a mobile citizens training unit.
He said that for Bal Harbour to participate with other munic-
ipalities in the area, it would cost approximately $300 for
the testing and $400 for the citizens information unit. It
was moved by Mr. Taplin, seconded by Mr. Beatty and voted that
Resolution No. 271
be adopted authorizing participation in the psychological
testing plan.
It was moved by Mr. Taplin, seconded by Miss Gray
and voted that

be adopted authorizing participation in the citizens train-
ing unit.
Mr. Maley said he had been informed by the City of Miami
Beach that we will not be billed for sewer charges until
October, and asked that the Council waive the charges for
September. It was moved by Mr. Beatty, seconded by Mr. Krez
and voted that our new sewer service charges will not be
effective until the month of October.
Mr. Maley reported that Bal Harbour has received a
letter from Dade County regarding the provision that cities
may operate their own fire and rescue services in lieu of
the new County Taxing District. He said that the towns
served by the Bakers Haulover Fire Station will be paying
more than their share of the cost of operating this station,
which also serves the county area to the north. It was
suggested that we develop data to support our claim and
present it to the county manager for relief, or go to the
commission.
Mr. Taplin said the helicopters were flying too low
over the beach and buildings again. Mr. Maley said if he
would get their colors he would contact the companies re-
garding this.
Mr. Maley reported that a regulatory fee of 1.5% of
water and sewer sales has been assessed by Dade County,
and that he recommends absorbing the fee in our present
rates for the time being.
The Village Manager reported that we have re-
ceived bids from fifteen insurance companies for hospitali-
zation insurance due to a requested 32% raise in our rates
by Equitable Life Assurance Company. He said that after
consideration, Time Insurance Company has been chosen as
the new carrier at a savings both to the village and the
employees who insure their dependents.
Mayor Printup said that he had a copy of a letter from
Dade County to the Town of Surfside covering the land-
scaping on 96th Street. Mr. Maley said we had worked out
an arrangement with Surfside and they would maintain the
first two islands on the east side and we will maintain the
two west islands.
On motion of Miss Gray, seconded by Mr. Beatty and
voted the meeting was adjourned at 12:10 P.M. -

A Public Hearing was held September 30, 1980 at 5:15
P.M. in the Village Hall to consider the tentative 1980-81
Budgets and the proposed millage rate.
Present: Messrs. Beatty, Krez and Printup
Absent: Miss Gray and Mr. Taplin
Also present were Fred W. Maley, Village Manager and
Mary T. Wetterer, Village Clerk.
Mr. Maley said that our tax roll assessments had in-
creased dramatically with the new construction and the full
value assessment required by State law. The millage is
reduced to 3.564, with the present homestead exemption
allowance under the formula dictated by the "TRIM Act. How-
ever, to fund the proposed budget he is asking for a 3.77
mills under present homestead exemption or 3.79 if the in-
creased homestead exemption bill passes. This would be a
5.79% increase in taxes. Mr. Maley then explained the
Capital Projects in the proposed budget which necessitate
the small raise in taxes.
