RESOLUTION NO. cJ
RESOLUTION GRANTING AN AMENDED
CONDITIONAL USE PERMIT FOR J-B FARMS
WHEREAS, a conditional use permit was granted by the City on January 7,
1986, for a horse training and breeding facility at 4650 Maple Street; and
WHEREAS, Beatryce Moyle and Dale J. Monson (Applicants) have requested
permission to construct an additional 70' X 90' barn on the property; and
WHEREAS, the proposal has been reviewed by the Planning Commission on
December 13, 1988, and City Council on January 3, 1989; and
WHEREAS, it has been determined that the existence of an additional 70' X
90' barn will not impede the orderly development of adjacent property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina
that an amended conditional use permit for the stated purpose is hereby
granted, subject to the following conditions:
1. The number of accessory buildings shall not exceed five and they shall
not occupy an area in excess of 1 1/2 percent of the 45 acre parcel and
all accessory buildings housing animals shall be and shall remain at
least 150 feet from all present and future lot lines;
2. The number of horses at the facility shall not exceed 60 at any time;
3. No toilet facility requiring a drainfield shall be constructed at the
arena;
4. Manure removal shall conform to the regulations of the Minnesota
pollution control agency;
5. The number of employees at the facility shall not exceed 10 and employee
parking shall be on the lot located to the north of the existing barn as
indicated on Exhibit A;
6. The Applicants shall cause traffic associated with all horse
aCtivity to be restricted to the Maple Street entrance from County
Road 19;
7. The Applicants shall execute an agreement with the City in a form satisfactory
to the city attorney agreeing to contribute one-third of the cost of improving
Maple Street, not to exceed $15,000, when it is upgraded;
8. Any signs shall conform to zoning ordinance standards applicable to residential
districts;
9. There shall be no outside public address system;
10.The hours of operation of the facility shall be restricted to 6:00 a.m. to
midnight daily;
11.The Applicants shall install two mercury vapor fixtures for outside lighting,
which fixtures shall be downward facing so as not to broadcast light off
the premises;
12.There shall be no outside storage allowed except for licensed vehicles and
trailers and one tractor with a manure spreader;
13.A11 fencing on the property shall be kept in good operating condition;
14.The Applicants shall dedicate the necessary right-of-way for Maple Street
as determined by city staff;
15.The Applicants shall hold no more than two major horse shows per year at the
facility, which shows shall be subject to city regulations involving special
events; and
16.The Applicants shall pay to the city a fee in the amount necessary to re-
imburse the city for its cost in reviewing this application for an amended
conditional use permit.
