( 1,/7• ‘, RESOLUTION GRANTING A VARIANCE TO JACK EBERT WHEREAS, Jack Ebert (Applicant) has requested a variance to reduce the setback from the lake to his house from 75 feet to feet to construct a deck at 2795 Co. Rd. 19; and WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission considered the Applicant's request and on December 13, 1988, recommended approval thereof; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicant regarding his request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant's request for a variance to reduce the setback from his deck to the lake to feet on the grounds that similar variances have been granted to neighboring properties. The variance is granted subject to the following conditions: 1. The area of the deck shall not exceed 108 square feet with a maximum encroachment towards the lake of eight feet; 2. Construction of the deck shall be of open slatted design with a membrane beneath. The slats shall be consistent with those on other decks in the Dockside development and comply with the building code; 3. The deck shall not be enclosed or covered on top; 4. Plantings on the fence shall not extend past the gate; 5. The Applicant acknowledges that there shall be no additional variances, encroachments or decks on the subject property; 6. The deck must be constructed within one year of the date of approval of this resolution or the variance hereby approved shall lapse; and 7. The Applicant shall pay to the city a fee to reimburse the city for its expenses in reviewing this variance application. Dated: eriLtd-IttAfd /'f 1989.
