RESOLUTION N0. 81-57
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LYNWOOD, CALIFORNIA DETERMINING THAT A NUISANCE
IS BEING MAINTAIiVED GN CERTAIN PROPERTY AND
DLRECTING THE ABATEMENT THEREOF.
WHEREAS, the City Manager of the City of Lynwood has re-
commended that this City Council find that a certain premise within
_ the City of Lynwood may be maintained in such a way as to constitute
a nuisance;_ and,
WHEREAS, certain .procedures are set forth in Chapter 21
of .the City Code of the. City of Lynwood, pursuant to which nuisances
may be abated; `
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYDIWOOD.
~ DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The property described as Lot 5, Tract 5686
and .generally known as 11822 Atlantic Avenue, Lynwood, California
is hereby found. and declared to be a public nuisance as defined
in Chapter 21 of the Lynwood City Code.
Section 2. The particular conditions of said property
which is-hereby found and determined to constitute a nuisance are
described as follows:
1. Vacant. lot overgrown with grass and weeds.
2. Large pile of concrete and. dirt in center of lot.
3: Storage of pews and-other material in rear-and side
of~ lot..
4. Inoperative. or dismantled vehicles on lot.
Section 3. It is further found and determined that~in
order to abate said nuisance it will be necessary that the following
steps.. be taken
1. Hem~ove ala, ~~cnc'rete and dirt from center of lot.
2. Remove inoperativA or dismantled vehicle from lot.
3. Remove pews and other material which is stored on lot.
4. Mow all grass and weeds and maintain regular lawn service..
Section 4. The owner of said property, Reverend John
Henderson of the Christ New Testament Missionary Baptist Church, is
ordered and directed to take said steps and to abate said nuisance.
Section 5 . _ If the property owner fails to .take the steps -- - -~
-- - as~~provided in'this resolution within. thirty (30) days after the date
. this resolution is posted upon the property, the City of Lynwood shall
immediately cause the same to be abated by City personnel. or private
contract' and such personnel or persons under contract are expressly
authorized to enter upon the premises for~such purpose.
Section 6. In the event the Gity of Lynwood causes the
aforementioned nuisance to be abated by City personnel or private
contract, the owner of the premises shall be liable to said City i
for all costs of such abatement,- includinq_ all administrative costs. ~
All said costs shall constitute a special assessment against the
subject property.
Section 7. The City Clerk is authorized and directed to
post conspicuously~at least one copy of this resolution on the subject
property and to send another copy of this resolution by registered or
certified mail, postage prepaid, return receipt requested, to
the owner of the land as his name and address appear on the last
equalized assessment roll or is known to the City Clerk. _
The failure o~f any owner or other person to receive such
notice shall not affect in any manner the validity of any pro-
ceedings taken hereunder.
