HomeMy Public PortalAbout1989-11Member 5c e,r ‘/- introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. o ) -/ RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO WAYNE POPHAM AND JOAN POPHAM WHEREAS, Wayne Popham and Joan Popham (Applicants) have applied for permission to construct a 3,300 square foot accessory building on their property located at 2725 Hamel Road; and WHEREAS, the City's zoning ordinance requires a conditional use permit for any accessory structure exceeding 3,000 square feet; and WHEREAS, this matter has been reviewed by the planning commission on January 10, 1989, and by the City Council on February 7, 1989; and WHEREAS, it has been determined that the existence of an accessory structure having 3,300 square feet will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicants for the stated purpose, subject to the following terms and conditions: 1. The accessory structure shall not exceed 3,300 square feet in size on both levels; 2. There shall be no living quarters in the accessory structure; 3. Fencing on the property shall be maintained in good repair; 4. The Applicants acknowledge that the accessory structure shall be only for their private non-commercial use; 5. The Applicants shall cause manure to be removed from the property in accordance with the standards of the Minnesota pollution control agency; 6. The Applicants shall control runoff from the riding ring and the area used for manure storage in a manner satisfactory to the city staff; 7. The amount of dirt to be removed from the site shall be reviewed by the city staff; 8. There shall be no exterior loud speakers on the property; 9. The maximum number of horses which may be kept on the property at one time shall be four; 10. The Applicants shall submit their site plan for review by the fire department; 11. A11 exterior lighting on the property shall be residential in character and shall be designed and installed so as not to cast light onto adjacent properties; 12. The Applicants shall submit a landscaping plan to be approved by the city staff; 13. The accessory building shall comply with all city ordinances, including setback requirements; 14. The Applicants shall reimburse the City for all costs, including legal expenses, involving in enforcing any provision of this conditional use permit or any ordinance related thereto; and 15. The Applicants shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application.
