HomeMy Public PortalAbout81-076 (06-16-81) RESOLUTION N0. 81-76 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING RULE XV SECTION 4 OF THE PERSONNEL RULES AND • RE GULATIONS WHEREAS, the Personnel Board has identified certain inadequacies in Rule XV Section 4 of the Personnel Rules and Regulations and recommended that same be amended as specified below; and WHEREAS, City of Lynwood Association Representatives and the City Attorney- have reviewed ~and~ app "roved-'-the ~~amerid'merit of Rule XV"Section 4 'o'f ~ ~' •' the Personnel Rules and Regulations, NOW, THEREFORE, the City Council of the City of Lynwood does hereby resolve that: Personnel Rule XV, Section 4 be amended to read: ~~Section 4. Complaints - Any permanent employee in the classified service shall have the right to appeal to the Personnel Board rela- tive to any disciplinary action, suspension, dismissal, demotion, reduction in pay, alleged discrimination as defined herein, or alle- ged violation of the Personnel Ordinance or Personnel Rules and Regu- lations. Failure on the part of the authority taking disciplinary action to provide the predisciplinary safeguards prescribed in Rule XV, Section 1 and 2 above will void the initiating action. The disciplined emplo- yee shall fully comply with all the provisions of the appeal procedure set forth below, and the employee's failure to do so will bar the right of appeal. Allegations of discrimination and of specific violations of the Person- nel Ordinance or Rules and Regulations, which are not part of discip- linary actions, shall first be submitted in writing through the .chain of command. Only if satisfaction is~not attained at the immediate supervisory and subsequently Department Head level shall the employee utilize the appeal procedure set forth below for such allegations. It is the employee's responsibility to provide the immediate super- visor with a statement of the protested act and the remedy sought within five (5) working days of the alleged incident. If the employee remains dissatisfied after five (5) further working days, the material shall be submitted to the. Department Head, if different from the imme- diate supervisor. A .copy should be given to the person assigned .the duties of the Personnel Officer, but only if this is not the City Mana- ger. The appeal procedure is as set forth below: Within five (5) working days after receiving the Department's decision - - to impose•discipline•or after_submit.ting the.statement.of.alleged dis- _..__ crimination or violation of Personnel laws to the Department Head with- out satisfaction the affected employee may request in writing, attach- ing copies of all related material, that the City Manager review the action':. The employee shall also provide copies of the appeal to the Department Head and Personnel, if personnel duties have been delegated by the City Manager. Within five (5) working days the City Manager shall conduct what- ever investigation is deemed necessary and either revise the action to the employee's satisfaction or notify the employee in writing of the decision to uphold an action not favored by the employee. Copies of a written decision will be provided to the Department Head and Per- sonnel. Within five (5) calendar days after receipt of an unfavored decision from~the City Manager., the employee may file a written demand with Personnel requesting a hearing before the Personnel Board. Within thirty (30) calendar days after the filing of such demand the Per- sonnel Board shall conduct a hearing in the matter. All material relating to the appealed action shall be provided to the Personnel Board at the scheduled hearing. If extenuating circumstances warrant, the Personnel Officer may grant an extension to any of the deadlines specified above."
