U 7 RESOLUTION GRANTING AN AMENDED CONDITIONAL USE PERMIT TO HAMEL PROPERTIES WHEREAS, Hamel Properties - Rolf Westgard - (Applicant) has applied for an amended conditional use permit for a business development at 610-640 Hamel Road; and WHEREAS, the Applicant was previously granted a conditional use permit for the property at 640 Hamel Road; and WHEREAS, the City's zoning ordinance requires an amended conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on February 14, 1989, and by the City Council on March 7, 1989; and WHEREAS, it has been determined that the business development will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that an amended conditional use permit be granted to the Applicant for the stated purpose, subject to the following terms and conditions: 1. The exterior storage on the site shall be in compliance with the landscaping plan of January 19, 1989, and city staff shall review the exterior barrels containing liquids; 2. The exterior building materials shall be installed in compliance with the plans and sequence outlined in the Applicant's letter; 3. All signs on site shall be in compliance with city code and shall be reviewed by city staff; 4. The present screening and landscape plan show minimum amounts and all elements of such plans shall be maintained; 5. Exterior trash containers shall be screened; 6. The Applicant shall dedicate the drainage and utility easements identified by the city engineer; 7. Parking in accordance with the plan is adequate at this time; 8. Staff shall determine the percentage of hardcover on the site and recognizes that it will be a reduction; 9. Hours of operation and number of employees shall be handled by staff through administrative conditional use permits; 10. Lighting on buildings to the south shall be reviewed by city staff and exterior lighting on the site shall be designed and installed so as not to cast light onto adjacent properties; 11. There shall be no exterior loudspeakers on site; 12. The fire department shall review the site for compliance with relevant ordinances and codes; 13. Fuel stored on site shall be handled in a manner consistent with MPCA regulations; 14. The Applicant shall dedicate to the city the right-of-way along Hamel Road identified by the city engineer; 15. The Applicant shall comply with the requirements specified by the city engineer in his letter dated February 9, 1989; 16. The Applicant shall supply a design approved by staff for decorative treatment of the exterior wood such as painting an accent stripe on the building; 17. The provisions of this amended conditional use permit supersedes the conditional use permit issued to Rolf Westgard on November 19, 1985, pursuant to resolution no. 85-121; 18. The Applicant shall reimburse the city for all costs, including legal expenses, involved in enforcing any provision of this conditional use permit on any ordinance related thereto; and 19. The Applicant shall pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this conditional use permit application; Dated: A.g.itl/ , 1989.
