HomeMy Public PortalAbout1989-18Member introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. �cl / D RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ROBERT ROMFO AND ANITA ROMFO WHEREAS, Robert Romfo and Anita Romfo (Applicants) have applied for a conditional use permit for a dog kennel at 2832 Hamel Road; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, it has been determined that the existence of the proposed dog kennel will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicants for the stated purpose, subject to the following terms and conditions: 1. There shall be no more than 40 dogs kept on the property at any time; 2. There shall be a maximum of 8 runs which shall not exceed 13,500 square feet; 3. Hours of operation shall be 24 hours per day, 7 days per week; 4. All waste material shall be disposed of in accordance with the ordinances of the city and the regulations of the Minnesota pollution control agency; 5. The Applicants shall take immediate and appropriate action to abate any nuisance caused by barking dogs on the property. For this purpose, a nuisance shall include, but not be limited to, 10 minutes of continuous barking; 6. No dogs shall be sold or used for experimental purposes; 7. The Applicants shall maintain all dogs in accordance with the standards of the Minnesota purebred dog breeders association; 8. The Applicants agree to take whatever steps may be necessary to reduce outside visual stimuli for the dogs in the kennel if excessive barking becomes a problem; 9. The city shall conduct an annual review of the property to ensure continued compliance with the terms and conditions of this permit; 10. The city reserves the right to modify or amend the terms and provisions of this conditional use permit as development occurs on adjacent properties if necessary to prevent the occurrence of a nuisance; 11. The Applicants shall pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this conditional use permit application; and 12. The Applicants shall reimburse the city for all costs, including legal expenses, involved in enforcing any provision of this conditional use permit or any ordinance related thereto.
