RESOLUTION GRANTING A
VARIANCE TO STEPHEN EUERLE
WHEREAS, Stephen Euerle (Applicant) has requested a variance to construct
a deck 17.5 feet from his front property line on his property at 2955 Ardmore
Avenue; and
WHEREAS, the City's zoning ordinance requires that structures maintain a
minimum front yard setback of 30 feet; and
WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat.
Section 462.357 require that variances from the strict interpretation of the
zoning ordinance be granted only when there is a demonstrated hardship because
of circumstances unique to the property; and
WHEREAS, the planning commission considered the Applicant's request and
has recommended approval thereof; and
WHEREAS, the City Council has bad an opportunity to review the matter and
to hear from the Applicant regarding his request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that the Applicant's request for a variance to reduce the required
front yard setback from 30 feet to 17.5 feet for a deck, subject to the
following conditions:
1. The Applicant shall install hand rails around the deck and on the
steps;
2. There shall be no side or roof enclosure of the deck;
3. The height of the deck above ground shall be reviewed by city staff;
4. The Applicant shall reimburse the city for all costs, including
legal expenses, involved in enforcing any provision of this variance
or any ordinance related thereto; and
5. The Applicant shall pay to the city a fee in the amount determined
by the staff to represent the actual cost to the city of reviewing
this variance application.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City of Medina that the
hardships justifying the granting of the above variance are the need for a
front exit from the house and the consistency of the setback with those of
other properties in the neighborhood.
