CITY OF MEDINA
RESOLUTION NO.
RESOLUTION DENYING A
CONDITIONAL USE PERMIT
AND VARIANCES TO
ARTHUR ELLIS AND PAULINE ELLIS
WHEREAS, Arthur Ellis and Pauline Ellis (Applicants) have applied for a
conditional use permit to construct two single family residential structures
on the property located at 1195 Hackamore; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, the Applicants have also requested variances to reduce the
setback of the proposed houses from Lake Medina; and
WHEREAS, these matters have been reviewed by the planning commission on
March 22, 1989, and by the City Council on April 4, 1989.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
Minnesota that the conditional use permit requested by the Applicants be
denied because of the lack of sufficient soils to accommodate septic systems
for both houses in case of future subdivision.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of the City of
Medina that the variances requested be denied because the Applicants have
demonstrated no hardship in being able to comply with the required setback
from Lake Medina.
