WHEREAS, as part of the Metropolitan St. Louis Sewer District’s (MSD)
continued commitment to the utilization of certified Minority and Women Business Enterprises
(MWBE) and minority and woman workforces in all aspects of its contracting activities, a 2022
Disparity Study Update has been completed (by Mason Tillman) that recommends MWBE
contracting and minority and woman workforce goals; and
WHEREAS, the purpose of the 2022 Disparity Study Update was to determine
whether or not a statistically significant disparity existed in MSD’s award of contracts to ready,
willing, and able MWBEs and recommend remedies to enhance the procurement activities and
MSD’s contracting program; and
WHEREAS, the Board of Trustees accepts the 2022 Disparity Study Update and
desires that MWBEs and minority and woman workforces shall have the maximum opportunity to
participate in MSD projects in a manner consistent with federal and state law; and
WHEREAS, the Board of Trustees has directed the Executive Director to monitor
all data and information available regarding MSD’s MWBE program prior to and after
implementation of any program revisions; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT, that the Executive Director is hereby
delegated full and complete authority to revise MSD’s existing Minority and Women Business
Enterprises (MWBE) and minority and women workforce inclusion program in accordance with
the Disparity Study’s recommendations and analysis by MSD and its contractors of any future data
and information gathered through stakeholder input.
Section One: A revised Minority and Women Business Enterprises (MWBE) and
minority and women workforce inclusion program will be implemented for projects whose
solicitation process begins no later than July 1, 2023, in accordance with the Disparity Study’s
recommendations and analysis by MSD and its contractors of any future data and information
gathered through stakeholder input.
