AN ORDINANCE, making an appropriation of Two Million Dollars
($2,000,000.00) from the Emergency Fund to be used for emergency repair in Emergency Repair
#070 (Blair & Ferry MH Replacement) (13829) in the City of St. Louis, Missouri; and authorizing
the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer
District to enter into Contract No. 22188 with Unnerstall Contracting Co., LLC for emergency
repair.
WHEREAS, the Executive Director declared this project an emergency on June 8,
2022; and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Million Dollars ($2,000,000.00) is hereby
appropriated from the Emergency Fund to be used for emergency repair in Emergency Repair #070
(Blair & Ferry MH Replacement) (13829) in the City of St. Louis, Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to enter into an emergency
construction contract under Contract No. 22188 with Unnerstall Contracting Co., LLC for
emergency repair in Emergency Repair #070 (Blair & Ferry MH Replacement) (13829) in the City
of St. Louis, Missouri; and said contract shall be comprised of such other terms and conditions as
are approved by the Office of the General Counsel of the District.
Section Three. Emergency Clause. This ordinance needs to be enacted without
delay, thus creating an emergency within meaning of the Charter, due to the immediate need to
repair the undermining of Blair Avenue caused by the failure of the MH structure. Accordingly,
this ordinance shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted on July 14, 2022
