O 9--3.� RESOLUTION GRANTING AND DENYING VARIANCES TO RAYUIOND WALD WHEREAS, Raymond Wald (Applicant) has requested the following variances to reconstruct his house and to build a new detached garage on the property located at 2971 Ardmore Avenue, legally described as Lot 11, Block 20, Independence Beach, Hennepin County, Minnesota: For The House - Required Setback Requested Setback Variance Front Yard (from Pine Street) 30' 26.1' 3.9' Front Yard (from Ardmore) 30' 18' 12' Rear Yard 30' 8' 22' For The Garage Front Yard (from Ardmore) Rear Yard Required Setback Requested Setback Variance 30' 26.1' 3.9' 30' 9.9' 2 0.1' WHEREAS, Section 825.45 of the City's zoning ordinance and Minn. Stat. §462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission has considered the Applicant's request and has recommended approval of the first five of the above variances but recommended denial of the sixth variance; and WHEREAS, the city council has had an opportunity to review the matter and to hear from the Applicant regarding his request. NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of Medina, Minnesota that the Applicant be granted the first five variances listed above, subject to the following conditions: 1. The deck to be constructed on the front of the house shall be used for front access to the residence; and 2. The roof of the house shall not overhang the deck by more than 3' and the deck shall not be roofed or enclosed; and 3. The Applicant shall pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of reviewing this variance application. BE IT FURTHER RESOLVED that the above five variances are granted because hardships are found to exist regarding the size of the lot, the presence of two front yards on the property, the location of the existing house on the lot and the setbacks of structures on neighboring properties. BE IT FURTHER RESOLVED By the city council of the City of Medina that the Applicant's request for the sixth variance listed above is denied on the grounds that no hardship exists which justifies the variance.
