HomeMy Public PortalAbout1989-35Member `S�-h�vs! introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. f fC� -3.� RESOLUTION GRANTING A VARIANCE TO GERALD TWEED WHEREAS, Gerald Tweed (Applicant) has requested a side yard setback variance to construct a 14' X 14' three season porch 15.7' from the property line on the house at 1295 Hackamore Road, which property is legally described on Exhibit A attached hereto; and WHEREAS, the City's zoning ordinance require a setback of 20' under such circumstance; and WHEREAS, Section 825.45 of the City's code of ordinances and Minn. Stat. 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the planning commission has considered the Applicant's request and has recommended approval thereof; and WHEREAS, the city council had an opportunity to review the matter and to hear from the Applicant regarding his request. NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of Medina, Minnesota that the Applicant be granted a side yard setback variance to construct a 14' X 14' three season porch not closer than 15.7' from the property line at 1295 Hackamore Road, subject to the following conditions: 1. The Applicant shall extend the fence screening the business equipment to the satisfaction of the city staff and shall keep the fence in good repair at all times; 2. The Applicant shall dedicate the right-of-way for Hackamore Road as required by the city engineer; 3. City staff shall review if the lot to the east has been combined; 4. It is acknowledged that there is a commercial business located on the property operated by the Applicant; and 5. The Applicant shall pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of reviewing this variance application. BE IT FURTHER RESOLVED By the City Council of the City of Medina that the hardships found to exist which justify the granting of the variance are the location of the existing house on one side of the lot and the internal room configuration of the existing structure.
