WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in all matters been complied with, as said property owner submitted to the Planning and Zoning Commission and City Council a Preliminary PUD Plan for the above referenced property. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. The Preliminary PUD Plan submitted by Gavin Bargate, Consultant, and on file as Case No. P10021 in the Jefferson City Planning Division is hereby approved for the above land referenced herein. SECTION 2. The underlying zoning district shall be C-1 Neighborhood Commercial for the purposes of establishing permitted uses, except that outdoor cooking, trash incineration, motor fuel sales, convenience stores, bars, and taverns shall be excluded from the list of permitted uses. SECTION 3. This approval includes Phase One, which shall consist of a building containing 8,281 square feet; and Phase Two, a building addition of 3,000 square feet. 1 SECTION 4. Common Areas and Public Land. No common areas are proposed and no lands are dedicated to public use with this PUD Plan. SECTION 5. This ordinance shall be in full force and effect from and after the date of its passage and approval. New Business—Public Hearings Case No. P10021 — 3520 West Edgewood Drive; Preliminary PUD Plan. Application filed by Women's Clinic Land Company LLC, property owner, Dr. Brian Stephens and Dr. Lorraine Dodson, authorized representatives,for a Preliminary PUD Plan to construct an 8,281 square foot medical office building. The property is located on the northwest corner of the intersection of West Edgewood Drive and Harpers Ferry. The property is described as part of Lot 3 of CC West Subdivision Section 2, Jefferson City, Cole County, Missouri. (Gavin Bargate, Consultant) Mr. Barron explained that the underlying zoning district is C-1 Neighborhood Commercial for the purpose of identifying permitted uses, with the exception that the following uses be excluded from the list of allowed uses: outdoor cooking, trash incineration, motor fuel sales, convenience stores, and bars and taverns. Mr. Barron explained that a bufferyard along the northern property line was installed by the Jefferson City Chamber of Commerce as a previous commitment for the development of the area. He described the elements of the PUD Plan, including the inclusion of cedar and pine trees for the "required" parking lot landscaping, which should be modified to reflect the use of deciduous trees, as listed in Appendix A of the Zoning Code. Mr. Barron described the signage proposed, which included a monument sign consisting of a maximum of 90 square feet of signage area and a maximum height of 12'6". He stated that a sidewalk, five feet in width, is proposed along West Edgewood Drive and along most of the frontage of Harpers Ferry. Mr. Gavin Bargate, 704 Primrose Court, Consultant for the proposed development, explained that the plan proposes the construction of a single story, 8,281 square foot Women's Clinic. He stated that the PUD Plan identifies a future "Phase 2" consisting of an additional 3,000 square feet. Mr. Bargate stated that the proposed development should be completed by the end of 2011. Mr. Lyle Rossburg, Chief Financial Officer of Jefferson City Medical Group, 1241 W. Stadium Boulevard, explained that the Women's Clinic is a division of the Jefferson City Medical Group (JCMG). He stated that the proposed development is situated very well for that area because it will not have a lot of after hour activities. He explained that the neighborhood would like to see the following concerns addressed: (1) stormwater management; (2) keep lighting from encroaching into the residential neighborhood; (3) keep traffic flow onto Harpers Ferry away from the residential neighborhoods; and (4) replace dead trees in the existing buffer area. No one spoke in opposition to this request and no correspondence was received. Mr. Barron gave the Planning Division staff report and outlined staff recommendations and conditions. He clarified that the property owner is responsible for maintenance to the buffer zone. Mr. Wade gave the Engineering Division staff report. He stated that storm water detention is not a specific requirement in this development, so long as downstream system capacities along West Edgewood Drive are not exceeded. Mr. Wade explained that the proposed development is served by existing sanitary sewer mains along W. Edgewood Drive and Harpers Ferry. He stated that some fire hydrants, street lights and utilities exist to serve this development, but facilities that do not yet exist will need to be installed in accordance with City standards. Mr. Bargate stated that he concurs with staff comments and recommendations. Mr. Jordan moved and Mr. Lester seconded to recommend approval of the Preliminary PUD Plan to the City Council subject to the following conditions: 1. Permitted signage shall consist of the following: (a) A monument sign with maximum height of 12'6" and maximum signage area of 90 square feet. The sign may be internally illuminated; (b) Building mounted signage consisting of a maximum of 100 square feet. The building mounted signage may be internally illuminated. 2. Parking Lot Landscaping: Revise the parking lot landscaping plan in order to show deciduous trees (rather than evergreen/cedar trees). Specific tree varieties shall be approved by Planning division staff prior to installation. 3. Compliance with the recommendations and technical corrections of the Planning and Engineering Divisions. Application filed by Women's Clinic Land Company LLC,property owner,Dr.Brian Stephens and Dr.Lorraine Dodson,authorized representatives,for a Preliminary PUD Plan to construct an 8,281 square foot medical office building. The property is located on the northwest corner of the intersection of West Edgewood Drive and Harpers Ferry. The property is described as part of Lot 3 of CC West Subdivision Section 2,Jefferson City,Cole County, Missouri. (Gavin Bargate, Consultant) Nature of Request The applicant is requesting approval of a Preliminary PUD Plan in order to allow for the construction of an 8,281 square foot medical office building and parking lot. Zoning History In 2005, a development proposal for a Kohls retail building was approved by the Planning and Zoning Commission and City Council. This proposal was for a large area along West Edgewood Drive that included this property. While the plans were approved, the development was never constructed. In January of 2008,a proposal for a Preliminary and Final PUD Plan for a 23,700 square foot medical office building on this site was scheduled to be heard by the Planning and Zoning Commission,but withdrawn prior the to meeting date. Location The subject property is located on the southwestern comer of the intersection of West Edgewood Drive and Ha ers Ferry. Adjacent zoning and land use is as follows: Surrounding Zoning Surrounding Uses North RS-I Single Family Residential South RA-1 and C-2 Vacant, approved for retail building East PUD Vacant West PUD Restaurant and undeveloped property Staff Analysis Parking: The parking requirement for medical office buildings is one parking space for every 200 square feet of gross floor area,resulting in a parking requirement of 42 spaces for this building. The PUD Plan shows 62 parking spaces. Permitted Uses: An underlying zoning district of C-1 Neighborhood Commercial for the purpose of identifying permitted uses is proposed by the PUD Plan with outdoor cooking, trash incineration, motor fuel sales, convenience stores, bars and taverns excluded from the list of allowed uses. Access/Traffic: Two driveway entrances to the property are proposed by the PUD Plan. One driveway is an existing driveway onto West Edgewood Drive and the other driveway would be a new driveway to access Harpers Ferry. A traffic study on file with the Department of Community Development,which was submitted in conjunction with previous development plans for the property, indicates that no turn lane improvement would be necessary to serve the site. Two driveway connections to the neighboring property to the west are also shown on the PUD Plan. One of these connections would align with an existing driveway on the Ria's restaurant property. Planning and Zoning Commission November 18, 2010 Case No. P10021 Paget Building Design: The PUD Plan indicates that the new building will be a single story building and will have an exterior wall finish of stone cladding on the lower half and synthetic stucco on the upper half. The coloring of the building is identified as earth tones and Spanish Cordova style roof tiles blended red and orange. The PUD plan outlines a future "phase 2"building addition consisting of 3,000 square feet. Landscaping: The PUD Plan calls out that parking lot landscaping will be installed in order to meet tile'5% coverage requirement outlined by the zoning code. The plan calls out that cedar/pine trees will be used for parking lot landscaping, which is not allowed by the zoning code. The parking lot landscaping trees should consist of deciduous trees, as listed in Appendix A of the Zoning Code. Bufferyard: A Bufferyard consisting of a 4 foot tall berm with trees 8-10 feet in height is shown along the northern property line. This bufferyard is existing in place and was installed by the Jefferson City Chamber of Commerce as a previous commitment for the development of the area. A reference to the landscapingylan dated July 16, 2007, which was submitted at the time of the PUD approval for the neighboring restaurant, is included in the bufferyard description. Signs: The PUD plan identifies a monument sign consisting of a maximum of 90 square feet of signage area and a maximum height of 12'6". No square footage for building mounted signage is indicated, however, building mounted signage is shown on the building elevation and visual. Lighting: The PUD Plan indicates that parking lot lighting will conform to the requirements of the C-1 zoning district. Sidewalks: The PUD Plan shows a 5 foot wide sidewalk along West Edgewood Drive and a 5 foot wide sidewalk along most of the frontage of Harpers Ferry. Sidewalk construction along the northernmost portion of the Harpers Ferry frontage is hampered by the close proximity of a creek to the street curb line. At the suggestion of City Staff,the proposed sidewalk is shown to cross Harpers Ferry and a short section of sidewalk would be installed on the eastern side of the road(in front of the Century Link utility building) in order to provide for appropriate sidewalk connectivity in the area. Staff Recommendation Staff recommends approval of the Preliminary PUD Plan subject to the following conditions: 1. Permitted signage shall consist of the following: a. A monument sign with maximum height of 12'6" and maximum signage area of 90 square feet. The sign may be internally illuminated. b. Building mounted signage consisting of a maximum of 100 square feet. The building mounted signage may be internally illuminated. 2. Parking Lot Landscaping: Revise the parking lot landscaping plan in order to show deciduous trees (rather than evergreen/cedar trees). Specific tree varieties shall be approved by planning division staff prior to installation. 3. Compliance with the recommendations and technical corrections of the Planning and Engineering Divisions. Jefferson City Planning & Zoning Commission Meeting Engineering Division Staff Report Thursday, November 18, 2010, 5:15pm Item 6. - New Business Case No. P10021 —Preliminary PUD Site Plan, Medical Offices, 3520 West Edgewood Drive (PUD) ENGINEERING STAFF RECOMMENDATION- Support approval of the preliminary PUD site plan, subject to technical corrections being made to the plan in accordance with the latest review by the Planning and Engineering Divisions. Existing Infrastructure Summary Infrastructure exists in the vicinity. * Storm water detention is not a specific requirement in this development, as long as downstream system capacities along West Edgewood Drive are not exceeded. Velocities and permanent erosion control will be necessary. * Sanitary sewer exists to serve this property along West Edgewood Drive and Harpers Ferry. * Sidewalk does not exist along West Edgewood Drive and Harpers Ferry on this property frontage. Infrastructure/Improvements Summary Storm Water/Erosion Control * Preliminary storm water systems have been proposed Preliminary sizes of structures and pipes still need to be included on the plan. * Rock blankets and pipe end sections have been provided at all outlets to the proposed storm water systems. An erosion and sediment control plan will be necessary with the final plan to address construction erosion control runoff. Sanitary Sewer The proposed development is served by existing sanitary sewer mains along West Edgewood Drive and Harpers Ferry. Sidewalk * A five (5) feet wide sidewalk is proposed along West Edgewood Drive and along Harpers Ferry. Street Access /Traffic Impact * A specific traffic impact study is not required for this plan. Previous proposals for this property have provided traffic analysis and recommendations for future traffic impact upon West Edgewood Drive. No additional requirements are needed with this proposal. Access is proposed to the development from an existing entrance constructed with West Edgewood Drive Improvements. An additional entrance to Harpers Ferry is being proposed approximately 150 feet back from the intersection with West Edgewood Drive. Access is also planned to connect into both the existing development to the west and with the future development to the west. r West Edgewood Drive is considered an arterial roadway. * Harpers Ferry serves as access to and from West Edgewood Drive for the residential subdivision to the north and to State Office Buildings to the north and east of this property. Additional undeveloped property to the north and to the east will also be served by Harpers Ferry, Fire Hvdrants /Street Lights !Utilities Some facilities exist to serve this development. Necessary facilities that do not yet exist will need to be installed in accordance with City standards to serve this development.
