WHEREAS, certain debris was removed from City Property at Segal Park; and WHEREAS,the debris removed from Segal Park was stockpiled at 13050 NW 30th Avenue, the property of Florida Industrial Properties Two, LLC; and WHEREAS, quotes were requested by the City Procurement Office and Cardulis Trucking was recommended to haul the debris in the amount of$12,000; and WHEREAS, after Cardulis Trucking was not able to perform the removal, the property owner requested permission from the City, to remove the debris itself, as it had a tenant waiting to lease the property; and WHEREAS,the City Commission of the City of Opa-locka ratifies the City Manager's action in authorizing the removal of the debris. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA,FLORIDA: Section 1. The recitals to the preamble herein are incorporated by reference. Section 2. The City Commission of the City of Opa-locka approves and ratifies the City Manager's action in authorizing Florida Industrial Properties Two, LLC to haul debris generated Resolution No 11-8223 during the construction at Segal Park, from the property located at 13050 NW 30`'' Avenue, Opa- locka, in the amount of Twelve Thousand Dollars ($12,000,00),payable from account 72-572630. Description: During construction of Segal Park, debris removed from the site was stockpiled at property address 13050 NW 30th Avenue, Opa-locka belonging to Florida Industrial Properties Two, LLC. Quotes were subsequently requested by Procurement for the hauling of the debris and a vendor Cardulis Trucking Inc. was recommended for the amount of $12,000. Cardulis Trucking subsequently went out of business and was unable to perform the work. The property owner Florida Industrial Properties, requested permission from the City to remove the debris. The debris has since been satisfactorily hauled from the property by the owner. Financial Impact: The cost of the hauling is $12,000 payable from account number 72-572630. Implementation Time Line: The debris was a hindrance to the property owner, as there was a tenant waiting to lease the property. It was necessary to move forward immediately and remove the debris. Legislative History: Resolution#09-7979 Recommendation(s): Staff recommended approval. Analysis: Staff has approved that the site has been cleared satisfactorily. Florida Industrial Properties, LLC submitted trucking tickets as proof of the hauling. The city has an obligation to reimburse the owner for the work performed. Consequently, there is no capacity left to expend money or procure the cleaning job unless the Commission grants a new approval since the cost is expected to be more than $5000. I have a draft for an agenda item but I have to ask Dr. Orji how to move ahead since this not exactly a competitive selection but rather an unsolicited offer from the property owner.
