HomeMy Public PortalAbout1989-38Member its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. 19- .g8 RESOLUTION GRANTING PRELIMINARY APPROVAL OF A SUBDIVISION FOR DAN-BAR HOMES FOR INDEPENDENTS ESTATES 2ND ADDITION WHEREAS, Dan -Bar Homes (Applicant) has requested approval of a plan to subdivide a parcel into eight lots according to the survey attached hereto as Exhibit A; and WHEREAS, the planning commission and city council have reviewed the preliminary plat submitted by the Applicant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that preliminary approval is granted to the Applicant for its subdivision, subject to the following conditions: 1. The grade on the curve at Walnut should be no greater than seven percent; 2. Ardmore south of Walnut shall remain as a platted street; 3. Walnut east of Birch to the unnamed road shall be taken care of by the Applicant; 4. Lots 5 and 6 are not a part of this approval; 5. It is acknowledged that the Applicant's dedication of Outlot A for parkland shall satisfy the park dedication requirements of this subdivision and for any lots which may be created from Outlot B in the future; 6. The presence of the driveway from JB Farms is acknowledged and that light from it may shine onto the platted property; 7. The following conditions of City of Medina resolution no. 88-50 adopted on June 21, 1988, are incorporated herein and made a part of this resolution; lb, 2 through 7, 10, 11 and 13 through 19; provided that the Applicant shall submit grading plans in response to item 1b and the easement dimensions in items 5 and 7 shall be adjusted by the city engineer; 3. The conditions outlined in the letter dated May 2, 1989, from the Pioneer Creek Conservation Commission to the Applicant shall be complied with; 9. No building permits shall be issued for construction of houses within the subdivision until the streets are improved with a rock base; 10. The Applicant shall construct the streets to city specifications; 11. The Applicant shall pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of reviewing the subdivision; 12. The Applicant shall submit a current abstract of title or registered property abstract covering all land within the subdivision for review by the city attorney; and 13. The Applicant shall submit the final plat to the city for approval within 180 days of the date of the adoption of this resolution, which final plat shall in all material respects conform to the preliminary plat, except that it shall incorporate all changes and modifications required by this resolution.
