ORDINANCE NO. 4 -7 '7
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI,AUTHORIZING THE CITY
COUNSELOR TO ACQUIRE CERTAIN PROPERTY BY PURCHASE OR BY
CONDEMNATION ON BEHALF OF THE PARKS AND RECREATION COMMISSION.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Council does hereby find, determine and declare it a public necessity
to acquire certain property,owned by Monica Belk and Sharon Kuschel-Heller, or such other
persons as may be determined to be lawful owners described more particularly in Exhibit
A, which is attached hereto and by this reference incorporated herein as if more fully and
completely set out.
Section 2. The purpose of acquiring such an easement is for use as a public
greenway.
Section 3. The City Council does hereby authorize the City Counselor to acquire said
property by purchase or condemnation, including the authorization to file a petition for
condemnation and to pursue such condemnation. The price to be paid in the event of
purchase is not to exceed the appraised value of the property by more than fifteen percent.
In the event of condemnation, the price to be paid shall be as set forth by the Court.
Section 4. This Ordinance shall be in full force and effect from and after the date of
its passage and approval.
