HomeMy Public PortalAbout1989-39Member d - - /a its adoption: introduced the following resolution and moved CITY OF MEDINA RESOLUTION NO. f- ,3 RESOLUTION GRANTING PRELIMINARY APPROVAL OF A SUBDIVISION FOR PHILIP CARLBERG WHEREAS, Philip Carlberg (Applicant) has requested approval of a plan to subdivide the property upon which the Maple Plain Dairy Queen is located according to the survey attached hereto as Exhibit A; and WHEREAS, the planning commission and city council have reviewed the preliminary plat submitted by the Applicant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that preliminary approval is granted to the Applicant for its subdivision, subject to the following conditions: 1. In light of the fact that the property exceeds the permissible percentage of hard surface coverage, the Applicant may maintain a gravel parking area for a truck turn -around but the remainder of the asphalt in that area of the site shall be removed and the area seeded or sodded; 2. The Applicant shall dedicate an easement for utility and drainage purposes over 30 feet on the north line of Parcel B; 3. The Applicant shall dedicate the right-of-way for County Road 19 and Highway 12 required by the city engineer; 4. The Applicant shall pay a park dedication fee for Parcel B in the amount determined by the city staff; 5. The Applicant shall dedicate 5 foot utility and drainage easements around the property lines as required by the city engineer; 6. The approval of this subdivision is contingent upon the Applicant obtaining a conditional use permit for the dairy queen business on the site; 7. The sign shall be checked by city staff for compliance with the city ordinance; 8. City staff shall determine the number of sewer units per parcel; 9. Any structure erected on Parcel B shall meet current city requirements regarding setbacks and performance standards; 10. The access point for Parcel B shall be on County Road 29 at least 150 feet from the intersection of Highway 12; 11. Any use constructed on Parcel B shall obtain a conditional use permit; 12. The six foot fence shall be extended to the front of the building and to the rear lot line; 13. Three additional units of landscaping shall be installed by the Applicant, which units shall be trees; 14. The Applicant shall pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of reviewing the subdivision; 15. The Applicant shall submit a current abstract of title or registered property abstract covering all land within the subdivision for review by the city attorney; and 16. The Applicant shall submit the final plat to the city for approval within 180 days of the date of the adoption of this resolution, which final plat shall in all material respects conform to the preliminary plat, except that it shall incorporate all changes and modifications required by this resolution.
