I "t 7 AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO MEMBERSHIP AND APPEAL RULES OF THE POLICE PERSONNEL BOARD. BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: Section 1. Chapter 7 (Boards and Commissions) Section 152 (Membership) is amended as follows: Sec. 7-152. Members. A. The police personnel board shall be composed of seven(7)members not,,,o,ethat,o,te-bitifofmitaviii shall be inenibe,s of the same political pat ty. Members of the board shall be appointed by the mayor with the consent of a majority of the elected members of the city council and shall serve for a term of three(3)years. The mayor,with the consent of a majority of the members of the city council,shall fill vacancies for any unexpired term. A member of the board may be removed for cause in the same manner as prescribed by this Code or other ordinances for the removal of other city appointive officers. Members of the board shall serve until their successors shall have been appointed and qualified. (Ord. 14337, §1,4-7-2008) B. Board members shall serve without compensation. (Code 1977, §§ 30-5-30-7; Code 1983, §24-41) State law reference-Police personnel board membership, RSMo. § 85.541,para.2(2). Section 2. Chapter 26 (Police) Section 28 (Appeals) is amended as follows: Sec.26-28.Appeals. Any member of the city police department who is demoted,suspended or discharged may appeal in m iting to the police personnel board,by making a written request for appeal to the City Clerk within thirty(30)calendar days after the effective date of such action,setting forth his reasons for claiming his demotion,suspension or discharge was not for good cause or for the good of the department.For the purpose of this section the term effective date of such Drafter's Note: Deleted text is shown this. Inserted text is shown thus S:\Myfiles\Council\Ordinances\'-)010-100.wpd action shall mean the date on which the employee receives notice of the disciplinary action.Upon such action the board shall,within twenty(201 t-n-Fl-ej days,hear the appeal,and the appellant,the chief of police and the appointing authority shall have the rightto be heard in person,to be represented by counsel and to present evidence at such hearing, which shall be a closed pubRe hearing unless the atthe regaestof die appellant requests a public hearing. Technical rules of evidence shall not apply at such hearing. Upon consideration of the evidence and within fifteen(15)days of the conclusion of the hearing, the board shall approve or disapprove the action appealed from and, in the event of a disapproval,the board shall order the appellant reinstated to his former position and payment of such salary as was lost to the appellant by reason of such demotion,suspension or discharge.
