HomeMy Public PortalAbout81-120 (09-01-81)•, ._ r RESOLUTION NO .' 81-120 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DETERMINING THAT A;' -_ NUISANCE TS BEING-MAINTAINED ON CERTAIN PROPER-- TY=AND DIRECTING THE ABATEMENT THEREOF. WHEREAS, pursuant to the recommendation of .the City Manager. of the City of Lynwood, this City Council has previously found that certain premises, hereinafter more fully described, may be.present- ly maintained in such a manner as to constitute a nuisance; and WHEREAS, in light of said finding, this Council adopted a reso- lution declaring its intention to conduct a public hearing to ascer- tain whether~a nuisance is being maintained on said property; and WHEREAS, this Council has held a hearing and has heard a.nd considered all relevant evidence and testimony from all interested persons desiring to be heard concerning the conditions constituting the,alleged.nuisance and the .proposed rehabilitation, removal 'and demolition thereof;. NOW, THEREFORE, the City Council of the City of Lynwood does hereby find, determine, order and resolve as follows: SECTION 1: The property described as Lot 60, Tract 921 and generally known as 2719 Fernwood Avenue, Lynwood, California, is hereby found and declared to be a public nuisance as defined in Chapter 21 of the Lynwood City Code. SECTION 2: The particular conditions of said property which are hereby found and determined to be a nuisance are described as - follows: 1) Accessory buildings being used as living quarters in violation of Zoning~Ordinance and Municipal Code. 2) Use of garage as living quarters. 3) Inoperative or dismantled vehicles on property. 4) Existence of electrical and plumbing systems which have been installed without proper permits and with- out compliance with Build Code provisions. SECTION 3: It is. further found and determined that, in order to abate said nuisance, it will be necessary that the following steps be taken: 1) Convert garage back to garage and cease to use as living quarters. 2) Cease using accessory buildings as living quarters and obtain appropriate building permits. 3) Remove or bring .into compliance all non-complying electrical and plumbing systems in structures in rear yard. . -- +`" .F~ SECTION 4: The owner of said property, Mr. Gurule, is order- ed and directed to take steps and to abate said nuisance. SECTION 7: In the event the City of Lynwood causes the afore- mentioned nuisance to be abated by City personnel or private contract, the owner of the premises shall be liable to said City for all costs of such abatement, including all administrative costs. All said costs shall constitute a special assessment against the .subject property.
