RESOLUTION GRANTING A
CONDITIONAL USE PERMIT TO
LARRY CLAUSNITZER DBA CABINET PEOPLE, INC.
WHEREAS, Larry Clausnitzer, dba Cabinet People, Inc. (Applicant) has
applied for a conditional use permit to construct a 52' x 70' addition to the building
at 815 Tower Drive for an expansion of a cabinet shop; and
WHEREAS, the City's zoning ordinance requires a conditional use permit
under such circumstances; and
WHEREAS, this matter has been reviewed by the planning commission on
May 9, 1989, and by the City Council on June 6, 1989; and
WHEREAS, it has been determined that the proposed building addition will
not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that a conditional use permit be granted to the Applicant for
the stated purpose, subject to the following terms and conditions:
1. The Applicant shall screen the dumpster on site according to ordinance
requirements and to the satisfaction of the city staff;
2. The Applicant shall install two additional units of landscaping, which shall
be trees or shrubs. All landscaping shall be maintained and replaced if
necessary;
3. Exterior lighting on the building shall be designed and installed so as not to
cast light onto adjacent properties or roadways;
4. The Applicant shall be aware of the dust situation and shall promptly take
action to mitigate any dust problem which arises;
5. The site and building interior shall be reviewed by the Hamel fire
department for compliance with all fire codes and regulations;
6. Administrative conditional use permits are required if any portion of
the building is rented out;
7. The Applicant shall designate and sign one parking stall for use by the
handicapped;
8. The clean out pipe southwest of the building shall be lowered into the ground
to the satisfaction of city staff;
9. The Applicant shall construct or make the following site improvements and
shall post a letter of credit in the amount of $16,750 to ensure completion
of same:
a) concrete curb and gutter along the west side of the parking lot;
b) drainage from the lot to be directed north along the west curb line to
Tower Drive; and
c) southwest corner of the lot to be raised to provide adequate drainage.
10. The Applicant shall pay to the City a fee in the amount determined by the
staff to represent the actual cost to the City of reviewing this conditional
use permit application; and
11. Violation of any term or condition of this conditional use permit shall be
deemed to be a violation of the city's zoning ordinance and shall be grounds
for revocation of this permit.
