RESOLUTION NO. 0 7 -43
RESOLUTION GRANTING A
VARIANCE FOR THE HAMEL LEGION
WHEREAS, the Hamel Legion (Applicant) has requested a variance to
construct an identification sign 2.33 feet from the front lot line at 75 Hamel Road;
and
WHEREAS, the City's zoning ordinance requires that such signs maintain a
minimum front yard setback of 10 feet; and
WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat.
Section 462.357 require that variances from the strict interpretation of the zoning
ordinance be granted onlywhen there is a demonstrated hardship because of
circumstances unique to the property; and
WHEREAS, the planning commission considered the Applicant's reuest and
has recommended approval thereof; and
WHEREAS, the City Council has had an opportunity to review the matter
and to hear from the Applicant regarding its request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that the Applicant's request for a variance to reduce the front
yard setback for an identification sign at the above property from 10 feet to 2.33
feet is granted, subject to the following conditions:
1. The sign may be illiminated no later than 1:00 a.m. when there is an activity
in the building and no later than 11:00 p.m. when there is no activity in the
building;
2. The Hamel Hawks sign shall be moved prior to erection of the illuminated
sign;
3. The existing signs on the building shall be removed at the time of the
erection of the illuminated sign; and
4. The Applicant shall pay to the city a fee in the amount determined by the
staff to represent the actual cost to the city of reviewing this variance
application.
BE IT FURTHER RESOLVED by the City Council of the City of Medina that
the variance hereby granted is justified by the following hardships:
1. The location of the existing Hamel Legion building;
2. The location of existing buildings on adjacent properties; and
3. Consistency with other signs in the vicinity.
