HomeMy Public PortalAbout15987 White Plains Sanitary Relief (Saltbox Dr. to Cedar Creek Rd) (12280)ORDINANCE NO. 15987 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as White Plains Sanitary Relief (Saltbox Dr. to Cedar Creek Rd) (12280) in the city of Chesterfield, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Chesterfield, Missouri within the Creve Coeur Creek Watershed wherein numerous people live and work; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as White Plains Sanitary Relief (Saltbox Dr. to Cedar Creek Rd) (12280) hereinafter set forth, said easements being more particularly described below: PARCEL #7 A 10-FOOT-WIDE SEWER EASEMENT across part of Lot 102 Of Shenandoah Plat 1, a subdivision according to the plat thereof recorded in Plat Book 134, Pages 36-37 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: 10-FOOT-WIDE SEWER EASEMENT: COMMENCING at the southeast corner of said Lot 102 of Shenandoah Plat 1; THENCE along the east line of said Lot 102, North 20 degrees 09 minutes 24 seconds East, 27.19 feet to the ACTUAL POINT OF BEGINNING of the centerline of said 10 FOOT WIDE SEWER EASEMENT; THENCE departing said east line of Lot 102, North 74 degrees 42 minutes 14 seconds West, a distance of 52.45 feet to the POINT OF ENDING of the centerline of said 10 FOOT WIDE SEWER EASEMENT, said point being on the south line of said Lot 102 of said Shenandoah Plat 1, said point also being distant along said south line, South 46 degrees 19 minutes 48 seconds East a distance of 23.70 feet from the southwest corner of said Lot 102. Excepting therefrom those portions covered by the existing 10 Foot Easements to Fee Fee Trunk Sewer, Inc. recorded in said Plat Book 134 Pages 36-37 and Deed Book 5903, Pages 119-122 of the St. Louis County, Missouri Recorder’s Office. Also, 2 TEMPORARY CONSTRUCTION EASEMENTS for the use during the construction, in the above-described sewer easement, said TEMPORARY CONSTRUCTION EASEMENTS being more particularly as follows: TEMPORARY CONSTRUCTION EASEMENT NO. 1: COMMENCING at the southeast corner of said Lot 102 of Shenandoah Plat 1; THENCE along the east line of said Lot 102, North 20 degrees 09 minutes 24 seconds East, 32.20 feet to the ACTUAL POINT OF BEGINNING of the herein described TEMPORARY CONSTRUCTION EASEMENT NO. 1; THENCE departing said east line of Lot 102, North 74 degrees 42 minutes 14 seconds West, 62.14 feet to the south line of said Lot 102; THENCE along said south line of Lot 102, North 46 degrees 19 minutes 48 seconds West, a distance of 13.18 feet to the southwest corner of said Lot 102; THENCE departing said south line of Lot 102 and along the west line of said Lot 102, North 20 degrees 09 minutes 24 seconds East, a distance of 29.69 feet to a point; THENCE departing said west line of Lot 102, South 27 degrees 10 minutes 05 seconds East, a distance of 35.03 to a point; THENCE South 74 degrees 42 minutes 14 seconds East, a distance of 48.42 feet to said east line of Lot 102; THENCE along said east line of Lot 102, South 20 degrees 09 minutes 24 seconds West, a distance of 10.04 feet to the POINT OF BEGINNING. Excepting therefrom that portion covered by the existing 10 Foot Easement recorded in said Plat Book 134 Pages 36-37 of the St. Louis County, Missouri Recorder’s Office. TEMPORARY CONSTRUCTION EASEMENT NO. 2: COMMENCING at the southeast corner of said Lot 102 of Shenandoah Plat 1; THENCE along the east line of said Lot 102, North 20 degrees 09 minutes 24 seconds East, 12.13 feet to the ACTUAL POINT OF BEGINNING of the herein described TEMPORARY CONSTRUCTION EASEMENT NO. 2; THENCE departing said east line of Lot 102, North 74 degrees 42 minutes 14 seconds West, 23.41 feet to the south line of said Lot 102; THENCE along said south line of Lot 102, North 46 degrees 19 minutes 48 seconds West, a distance of 21.04 feet to a point; THENCE departing said south line of Lot 102, South 74 degrees 42 minutes 14 seconds East, a distance of 42.77 feet to said east line of Lot 102; THENCE along said east line of Lot 102, South 20 degrees 09 minutes 24 seconds West, a distance of 10.04 feet to the POINT OF BEGINNING. Excepting therefrom those portions covered by the existing 10 Foot Easements to Fee Fee Trunk Sewer, Inc. recorded in said Plat Book 134 Pages 36-37 and Deed Book 5903, Pages 119-122 of the St. Louis County, Missouri Recorder’s Office. PARCEL #10 A 10-FOOT-WIDE SEWER EASEMENT across part of Lot 204 of Shenandoah Plat 2, a subdivision according to the plat thereof recorded in Plat Book 153, Pages 6-7 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: 10-FOOT-WIDE SEWER EASEMENT: COMMENCING at the southernmost corner of said Lot 204 of Shenandoah Plat 2; THENCE along the west line of said Lot 204 of Shenandoah Plat 2, North 04 degrees 26 minutes 13 seconds East, a distance of 13.37 feet to the ACTUAL POINT OF BEGINNING of the centerline of said 10 FOOT WIDE SEWER EASEMENT; THENCE departing said west line of Lot 204 of Shenandoah Plat 2, South 78 degrees 02 minutes 58 seconds East, a distance of 29.30 feet to the POINT OF ENDING of the centerline of said 10 FOOT WIDE SEWER EASEMENT, said point being on the south line of said Lot 204 of Shenandoah Plat 2, said point also being distant along said south line of Lot 204 of Shenandoah Plat 2, North 76 degrees 15 minutes 28 seconds East a distance of 30.57 feet from the southernmost corner of said Lot 204. Excepting therefrom that portion covered by the existing Easements to Fee Fee Trunk Sewer, Inc. recorded in Deed Book 5905 Pages 119-122 and Plat Book 153, Pages 6-7, of the St. Louis County, Missouri Recorder’s Office. Also, a TEMPORARY CONSTRUCTION EASEMENT for the use during the construction, in the above-described sewer easement, said TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: TEMPORARY CONSTRUCTION EASEMENT: COMMENCING at the southernmost corner of said Lot 204 of Shenandoah Plat 2; THENCE along the west line of said Lot 204 of Shenandoah Plat 2, North 04 degrees 26 minutes 13 seconds East, a distance of 18.41 feet to the ACTUAL POINT OF BEGINNING of the TEMPORARY CONSTRUCTION EASEMENT; THENCE continuing along said west line of Lot 204 of Shenandoah Plat 2, North 04 degrees 26 minutes 13 seconds East, a distance of 11.12 feet to a point; THENCE departing said west line of Lot 204 of Shenandoah Plat 2, South 66 degrees 49 minutes 03 seconds East, a distance of 5.28 feet to a point; THENCE South 78 degrees 02 minutes 58 seconds East, a distance of 57.41 feet to the south line of said Lot 204 of Shenandoah Plat 2; THENCE along said south line of Lot 204 of Shenandoah Plat 2, South 76 degrees 15 minutes 28 seconds West a distance of 23.07 feet to a point; THENCE departing said south line of Lot 204 of Shenandoah Plat 2, North 78 degrees 02 minutes 58 seconds West a distance of 40.35 feet to the POINT OF BEGINNING. PARCEL #11 A 10 FOOT WIDE SEWER EASEMENT across part of Lot 205 of Shenandoah Plat 2, a subdivision according to the plat thereof recorded in Plat Book 153, Pages 6-7 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: 10-FOOT-WIDE SEWER EASEMENT: COMMENCING at the westernmost corner of said Lot 205 of Shenandoah Plat 2; THENCE along the west line of said Lot 205 of Shenandoah Plat 2, North 36 degrees 10 minutes 33 seconds East, a distance of 20.52 feet to the ACTUAL POINT OF BEGINNING of the centerline of said 10 FOOT WIDE SEWER EASEMENT; THENCE departing said west line of Lot 205 of Shenandoah Plat 2, South 60 degrees 15 minutes 51 seconds East, a distance of 117.03 feet to the POINT OF ENDING of the centerline of said 10 FOOT WIDE SEWER EASEMENT, said point being on the east line of said Lot 205 of Shenandoah Plat 2, said point also being distant along said east line of Lot 205 of Shenandoah Plat 2, North 09 degrees 47 minutes 04 seconds East a distance of 16.38 feet from the southernmost corner of said Lot 205. Excepting therefrom that portion covered by the existing Easement to Fee Fee Trunk Sewer, Inc. recorded in Deed Book 5905 Pages 119-122, of the St. Louis County, Missouri Recorder’s Office. Also, a TEMPORARY CONSTRUCTION EASEMENT for the use during the construction, in the above-described sewer easement, said TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: TEMPORARY CONSTRUCTION EASEMENT: COMMENCING at the westernmost corner of said Lot 205 of Shenandoah Plat 2; THENCE along the west line of said Lot 205 of Shenandoah Plat 2, North 36 degrees 10 minutes 33 seconds East, a distance of 25.55 feet to the ACTUAL POINT OF BEGINNING of the TEMPORARY CONSTRUCTION EASEMENT; THENCE continuing along said west line of Lot 205 of Shenandoah Plat 2, North 36 degrees 10 minutes 33 seconds East, a distance of 10.06 feet to a point; THENCE departing said west line of Lot 205 of Shenandoah Plat 2, South 60 degrees 15 minutes 51 seconds East, a distance of 109.89 feet to the east line of said Lot 205 of Shenandoah Plat 2; THENCE along said east line of Lot 205 of Shenandoah Plat 2, South 09 degrees 47 minutes 04 seconds West a distance of 10.64 feet to a point; THENCE departing said east line of Lot 205 of Shenandoah Plat 2, North 60 degrees 15 minutes 51 seconds West a distance of 114.65 feet to the POINT OF BEGINNING. PARCEL #12 A 10 FOOT WIDE SEWER EASEMENT across part of Lot 206 of Shenandoah Plat 2, a subdivision according to the plat thereof recorded in Plat Book 153, Pages 6-7 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: 10-FOOT-WIDE SEWER EASEMENT: COMMENCING at the southwest corner of said Lot 206 of Shenandoah Plat 2; THENCE along the west line of said Lot 206 of Shenandoah Plat 2, North 17 degrees 15 minutes 03 seconds West, a distance of 13.78 feet to the ACTUAL POINT OF BEGINNING of the centerline of said 10 FOOT WIDE SEWER EASEMENT; THENCE departing said west line of Lot 206 of Shenandoah Plat 2, North 89 degrees 40 minutes 59 seconds East, a distance of 25.62 feet to a point; THENCE South 60 degrees 15 minutes 51 seconds East, a distance of 36.17 feet to the POINT OF ENDING of the centerline of said 10 FOOT WIDE SEWER EASEMENT, said point being on the east line of said Lot 206 of Shenandoah Plat 2, said point also being distant along said east line of Lot 206 of Shenandoah Plat 2, North 36 degrees 10 minutes 33 seconds East a distance of 20.52 feet from the southernmost corner of said Lot 206. Excepting therefrom that portion covered by the existing Easements to Fee Fee Trunk Sewer, Inc. recorded in Deed Book 5905 Pages 119-122 and on Plat Book 153, Pages 6-7, of the St. Louis County, Missouri Recorder’s Office. Also, a TEMPORARY CONSTRUCTION EASEMENT for the use during the construction, in the above-described sewer easement, said TEMPORARY CONSTRUCTION EASEMENT being more particularly described as follows: TEMPORARY CONSTRUCTION EASEMENT: COMMENCING at the southwest corner of said Lot 206 of Shenandoah Plat 2; THENCE along the west line of said Lot 206 of Shenandoah Plat 2, North 17 degrees 15 minutes 03 seconds West, a distance of 19.01 feet to the ACTUAL POINT OF BEGINNING of the TEMPORARY CONSTRUCTION EASEMENT; THENCE continuing along said west line of Lot 206 of Shenandoah Plat 2, North 17 degrees 15 minutes 03 seconds West, a distance of 10.45 feet to a point; THENCE departing said west line of Lot 206 of Shenandoah Plat 2, North 89 degrees 40 minutes 59 seconds East, a distance of 34.21 feet to a point; THENCE South 60 degrees 15 minutes 51 seconds East, a distance of 41.89 feet to the east line of said Lot 206 of Shenandoah Plat 2; THENCE along said east line of Lot 206 of Shenandoah Plat 2, South 36 degrees 10 minutes 33 seconds West a distance of 10.06 feet to a point; THENCE departing said east line of Lot 206 of Shenandoah Plat 2, North 60 degrees 15 minutes 51 seconds West a distance of 38.08 feet to a point; THENCE South 89 degrees 40 minutes 59 seconds West, a distance of 28.48 feet to the POINT OF BEGINNING. Excepting therefrom that portion covered by the existing Easement to Fee Fee Trunk Sewer, Inc. recorded on Plat Book 153, Pages 6-7, of the St. Louis County, Missouri Recorder’s Office. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted on October 13, 2022
