AN ORDINANCE, making a supplemental appropriation of Two Million Five
Hundred Thousand Dollars ($2,500,000.00) from the Emergency Fund to be used for emergency
repair in Emergency Repair #070 (Blair & Ferry MH Replacement) (13829) in the City of St.
Louis, Missouri; and authorizing the Executive Director and Secretary-Treasurer on behalf of The
Metropolitan St. Louis Sewer District to appropriate additional funds to Contract No. 22188 with
Unnerstall Contracting Co. LLC., for the aforesaid emergency repair services.
WHEREAS, Ordinance No. 15946, adopted July 14, 2022, appropriated the initial
funding for and authorize Contract No. 22188;
WHEREAS, the Executive Director declared this project an emergency on June 8,
2022; and
WHEREAS, the Director of Finance has certified that there is an unencumbered
balance in the above-named fund sufficient to pay the obligation authorized herein.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The sum of Two Million Five Hundred Thousand Dollars
($2,500,000.00) is hereby appropriated from the Emergency Fund to be used for emergency repair
in Emergency Repair #070 (Blair & Ferry MH Replacement) (13829) in the City of St. Louis,
Missouri.
Section Two. The Executive Director and Secretary-Treasurer are hereby
authorized on behalf of The Metropolitan St. Louis Sewer District to appropriate additional funds
to Contract No. 22188 with Unnerstall Contracting Co., LLC. for emergency repair in Emergency
Repair #070 (Blair & Ferry MH Replacement) (13829) in the City of St. Louis, Missouri, and shall
be comprised of such other terms and conditions as are approved by the Office of the General
Counsel of the District.
Section Three. Emergency Clause. This ordinance needs to be enacted without
delay, thus creating an emergency within the meaning of the Charter, due to the immediate need
to repair the sanitary sewer collapse and overflows from the sanitary system. Accordingly, this
ordinance shall take effect immediately upon its enactment.
