Greentrails Dr) (12200)OR DINANC E NO. 16004 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Saylesville Sanitary Relief (Saylesville Dr to S Greentrails Dr) (12200) in the City of Chesterfield, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of Chesterfield, Missouri within the Creve Coeur Creek Watershed wherein numerous people live and work; WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Saylesville Sanitary Relief (Saylesville Dr to S Greentrails Dr) (12200) hereinafter set forth, said easements being more particularly described below: PARCEL #4 A 10 FOOT WIDE SEWER EASEMENT across part of Lot 104 of “Green Trails Country Club Grounds Plat Eight”, a subdivision according to the plat thereof recorded in Plat Book 247, Pages 22-23 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: 10 FOOT WIDE SEWER EASEMENT COMMENCING at the southernmost corner of Lot 104 of said “Green Trails Country Club Grounds Plat Eight”; THENCE along the southeast line of said Lot 104, North 45 degrees 35 minutes 38 seconds East, a distance of 8.42 feet to the ACTUAL POINT OF BEGINNING of the herein described 10 FOOT WIDE SEWER EASEMENT; THENCE departing said southeast line of Lot 104, North 66 degrees 59 minutes 14 seconds West, a distance of 8.91 feet to a point; THENCE North 44 degrees 24 minutes 22 seconds West, a distance of 26.04 feet to a point; THENCE South 66 degrees 59 minutes 14 seconds East, a distance of 37.12 feet to said southeast line of Lot 104; THENCE along said southeast line of Lot 104, South 45 degrees 35 minutes 38 seconds West, a distance of 10.83 feet to the POINT OF BEGINNING. Excepting therefrom that portion covered by the existing 10 Foot Easement recorded in said Plat Book 247, Pages 22-23 of the St. Louis County, Missouri Recorder’s Office. Also, a 15 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT for the use during the construction, in the above described 10 FOOT WIDE SEWER EASEMENT, said 15 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT being more particularly as follows: 15 FOOT TEMPORARY CONSTRUCTION EASEMENT COMMENCING at the southernmost corner of Lot 104 of said “Green Trails Country Club Grounds Plat Eight”; THENCE along the southeast line of said Lot 104, North 45 degrees 35 minutes 38 seconds East, a distance of 19.25 feet to the ACTUAL POINT OF BEGINNING of the herein described 15 FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT; THENCE departing said southeast line of said Lot 104, North 66 degrees 59 minutes 14 seconds West, a distance of 37.12 feet to the northeast line of a 5 Foot Easement recorded in said Plat Book 247, Pages 22-23 of the St. Louis County, Missouri Recorder’s Office; THENCE along said northeast line of a 5 Foot Easement, North 44 degrees 24 minutes 22 seconds West, a distance of 2.48 feet to a point; THENCE departing said northeast line of a 5 Foot Easement, North 45 degrees 30 minutes 08 seconds West, a distance of 15.20 feet to a point; THENCE South 66 degrees 59 minutes 14 seconds East, a distance of 39.83 feet to said southeast line of Lot 104; THENCE along said southeast line of Lot 104, South 45 degrees 35 minutes 38 seconds West, a distance of 16.25 feet to the POINT OF BEGINNING. PARCEL #21 A 10 FOOT WIDE SEWER EASEMENT across part of Lot 37 of “Green Trails Country Club Grounds Plat One”, a subdivision according to the plat thereof recorded in Plat Book 219, Pages 54-56 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: 10 FOOT WIDE SEWER EASEMENT COMMENCING at the westernmost corner of said Lot 37 of “Green Trails Country Club Grounds Plat One”; THENCE along the northwest line of said Lot 37, North 32 degrees 53 minutes 55 seconds East, a distance of 43.94 feet to the ACTUAL POINT OF BEGINNING of the centerline of said 10 FOOT WIDE SEWER EASEMENT; THENCE departing said northwest line of Lot 37, South 43 degrees 04 minutes 00 seconds East, a distance of 73.58 feet to a point; THENCE South 68 degrees 14 minutes 15 seconds East, a distance of 82.22 feet to the POINT OF ENDING of the centerline of said 10 FOOT WIDE SEWER EASEMENT, said point being on the right-of-way line of Boxford Court (50 foot wide), said point also being distant along said right-of-way line of Boxford Court (50 foot wide), a distance of 7.93 feet from the southeast corner of said Lot 37 of “Green Trails Country Club Grounds Plat One”. PARCEL #34 A VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT across part of Lot 269 of “Trails West Section of the Village of Green Trails Plat One”, a subdivision according to the plat thereof recorded in Plat Book 114, Pages 18-21 of the St. Louis County, Missouri Recorder’s Office, said VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT being more particularly as follows: VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT COMMENCING at the southeast corner of said Lot 269 of “Trails West Section of the Village of Green Trails Plat One”, said point being a point of curve on the west line of Greentrails Drive (60 foot wide); THENCE along said west line of Greentrails Drive (60 foot wide), along a curve to the left having a radius of 1504.27 feet, an arc length of 17.30 feet and whose chord bears North 13 degrees 42 minutes 39 seconds East, a distance of 17.30 feet to the ACTUAL POINT OF BEGINNING of the herein described VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENT; THENCE departing said west line of Greentrails Drive (60 foot wide), North 78 degrees 01 minutes 02 seconds West, a distance of 12.23 feet to a point; THENCE North 11 degrees 58 minutes 58 seconds East, a distance of 40.00 feet to a point; THENCE South 78 degrees 01 minutes 02 seconds East, a distance of 12.67 feet to a point of non-tangential curve on said west line of Greentrails Drive (60 foot wide); THENCE along said west line of Greentrails Drive (60 foot wide), along a curve to the right having a radius of 1504.27 feet, an arc length of 40.00 feet and whose chord bears South 12 degrees 37 minutes 10 seconds West, a distance of 40.00 feet to the POINT OF BEGINNING. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out.
