November 25, 1980
The Council of Bal Harbour Village met Tuesday, November
25, 1980 at 9:30 A.M. in the Village Hall.
Present: Messrs. Krez, Printup, Taplin and Miss Gray
Absent: Mr. Beatty
Also present were Fred W. Maley, Village Manager; Mary
T. Wetterer, Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Miss Gray, seconded by Mr. Taplin and voted the
minutes of October 28, 1980 were approved as submitted.
A Public Hearing was held to consider a request by Bal Harbour
Shops for a variance to eliminate the 71/2 foot setback between
Building A and the Saks Fifth Avenue Building. Mr. Maley said
that he had hired the engineering firm of James D. Marks Associates
to review all the plans for the Bal Harbour Shops expansion. He
explained that the engineers had found, in addition to the elimin-
ation of the 71/2 foot setback that atone point on Building A, the
parapet wall is 8 inches over the allowable height. There are 24
parking spaces short for the overall additions planned. Mr. Lavrant,
representing the Shops, said that the parapet would conform to
our regulations and that the additional 24 parking spaces are pro-
vided by parking around the buildings which do not show on the
plans. He will have the plans modified. It was moved by Mr. Taplin,
seconded by Miss Gray and voted that inasmuch as the ground floor
of Building A is already attached, it would serve no useful purpose
to disallow it for the other two stories and that the request from
Bal Harbour Shops complies with Sec. 3 of Ordinance No. 217. Mr.
Gold said he will prepare the formal Resolution granting the variance.

Ordinance No. 223
revising the Bal Harbour Village Employees' Pension Trust. On motion
of Miss Gray, seconded by Mr. Krez and voted the Ordinance was
adopted on final reading.
Mr. James Rizzo explained his letter and the schedule pro-
viding various benefits for an alternate savings plan benefit for
key employees. After discussion it was the council's opinion
that this item would be held for the next meeting and in the mean-
time the council could discuss any items they did not understand
with Mr. Maley.
Mr. Maley said the rebidding of the job to provide additional
fire hydrants for fire flow resulted in two bids being received.
The low bidder is Reinertson Equipment. Company in the amount of
$45,750.00. Mr. Ed. Pickard from the construction company was pre-
sent and said the work could begin after the first of the year.
It was moved by Mr. Krez, seconded by Miss Gray and voted that
the contract be awarded to Reinertson Equipment Company.
Mr. Gold explained that he and Mr. Maley appeared before
the Dade County Zoning Appeals Board to protest a permanent com-
mercial heliport proposed for the Bakers Haulover park. However
the Board granted permission for the heliport over our objections.
He said our recourse now is to appeal to the Dade County Board of
Commissioners to reverse the decision. It was moved by Mr. Taplin,
seconded by Miss Gray and voted that Mr. Gold take whatever steps
necessary to present our case to the County Commission.
Mayor Printup said that due to our next scheduled meeting data
falling so close to New Year's Day that the council might wish to
hold the meeting on the alternate meeting date. It was the council's
decision to have the December meeting on the 9th of December.
Mr. Maley said the Sheraton has requested use of their garage
space for convention purposes from March 29th through April 3rd 1981.
On motion of Miss Gray, seconded by Mr. Taplin and voted the per-
mission was granted.
Mayor Printup said he had received a Resolution form North
Miami Beach urging the State & County to set up additional prison
facilities in Dade County. No action was taken on the matter.
On motion of Mr. Taplin, seconded by Mr. Krez and voted the
council agreed to send a 5100 contribution to the Carl Mertes Fund.
Mr. Taplin requested advice on fire protection for the high rise
apartments & hotels. Mr. Maley said that the Dade County Fire
Department maintains a Technical. Services Division that conducts
seminars for tenants & will also inspect buildings. He said he
would publish this in the Newsletter & also write the manager of
the buildings requesting them to take advantage of these services.
A complaint was made about the tour busses blocking the curb
lane at the Sheraton. Mr. Maley said he would take this up with the
police department again.
On motion of Mr. Krez, seconded by Mr. Taplin the meeting
was adjourned at 11:30 A.M.
