RESOLUTION AUTHORIZING RELEASE OF LIEN
WHEREAS, the Borough of Carterct (the "Borough") has paid workers
compensation benefits to Stephcn Moyhm in concnc[ion with an accident which
occun-ed on April 3, 1996; and
WHEREAS, pursuant to the Ne~v Jersey Worker's Compensation Act
(R.S.34:15-7) thc Borough has a lien on the proceeds of third party settlements
equal to the medical costs and temporary disability benefits paid by the Borough;
and
WHEREAS, the Borough is willing to release its lien in return for certain
reimbursemcnt.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of thc
Borough of Carteret that the Borough agrecs to release its lien for medical bills
and temporary compcnsation paid in return for payment in the amount of
$44,94O.65
BE IT FURTHER RESOLVED thai the Mayor and Municipal Clerk be and are
hereby authorized Io execute a release, substantially in thc form of the attached
Exhibit A and other documents requircd to accomplish the settlement on behalf of
thc Borough.
Adopted this 4th day of May, 2000
and certified as a true copy of the
original on May 5, 2000.
