' j_ ,„ RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO CARLBERGS-REEDERS FOR THE MAPLE PLAIN DAIRY QUEEN WHEREAS, Phillip Carlberg, Helvie Carlberg, Brian Reeder and Mary Reeder (Applicants) have applied for a conditional use permit to operate a Dairy Queen at T.H. 12 and Co. Rd. 29; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission in 1987 and again on April 16, 1989, and by the City Council on May 16, 1989; and IVHEREAS, it has been determined that the existence of the Dairy Queen will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicants for the stated purpose, subject to the following terms and conditions: 1. The sign shall be located as shown on the plan submitted to the city; 2. There shall be no exterior storage on the site; 3. All exterior building materials shall meet city performance standards; 4. The six foot fence shall be extended to the front of the buildings and to the rear lot line; 5. Three additional landscaping units shall be installed by the Applicant, which units shall be trees; 6. The on -site parking shall comply with ordinance standards; St 7. The trash container shall be adequately screened; 8. Hours of operation shall be limited to 9:00 a.m. to 12 midnight, seven days per week; 9. Exterior lighting and drainage shall be maintained as existing; 10. Any outside loudspeaker shall be controlled so as not to cause undue annoyance to persons off site; 11. The Applicants shall pay to the city a fee in the amount determined by the staff to represent the actual cost to the city of reviewing this conditional use permit application; and 12. Violation of any term or condition of this conditional use permit shall be deemed to be a violation of the city's zoning ordinance, and shall be grounds for violation of this permit.
