HomeMy Public PortalAboutORD 16/01ORDINANCE NO. 16/O1 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING THE TOWN'S CODE OF ORDINANCES, TO AMEND SECTION 66-397, OPEN LAND USES, TO ADD ADDITIONAL LANDSCAPING BUFFER REQUIREMENTS FOR TWO-STORY HOMES WITHIN CERTAIN ZONING DISTRICTS; TO AMEND SECTION 70-73, TWO-STORY STRUCTURES, TO PROVIDE ADDITIONAL SECOND -STORY SETBACKS IN CERTAIN ZONING DISTRICTS; TO AMEND SECTION 70-74, SETBACKS, TO REFERENCE SECOND -STORY SETBACK CHANGES; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 66, Zoning, Article VIII, Section 66-397, Open land uses, to read as follows (added language is underlined): Sec. 66-397. - Open land uses and buffers. (a) Open land uses shall mean open air parking lots, private or public. Any open land use area which abuts any public street right-of-way or abuts or is across an alley from any land used for residential use shall be required to provide a planting strip inside the property line. Such planting strip on the front property line shall be not less than three feet in width and shall be provided with a hedge of not less than one foot or more than three feet in height to form a continuous screen between the open land use and the public street right-of-way. (b) In the planting strip on land used for multiple -family residential which is abutting and/or immediately adjacent to single-family residential there shall be erected a living hedge not more than seven feet from the residential property line. Such hedge must be planted within 30 days after occupancy or use of the property, must be planted not more than three feet apart, and must be maintained at a height of not less than seven feet. (c) The area of the required planting strip not occupied by a fence or hedge shall be provided with grass or other plant ground cover material. In addition, one tree shall be provided for each 40 lineal feet of such landscaped area. Such trees shall be not less than eight to ten feet high at time of planting and be of such variety that at maturity they will have a crown spread not less than 15 feet. (d) For new construction or renovations of a second floor of a single family house within the Gulf Stream Core, North/South and Place Au Soleil zoning districts, trees shall be planted in a manner so as to provide a buffer of the full second story and in no event less than 40 linear feet along the side yards adjacent to the second story portion of the house. The subject trees shall be not less than ten to 12 feet in height at the time of planting and be of such variety that at maturity they will have a crown spread of not less than 20 feet. Existing trees that meet these minimum height and crown spread standards may be used to meet this requirement. Section 2. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 70, Gulf Stream Design Manual, Article IV, Site Development Regulations, Section 70-73, District Descriptions, to read as follows (added language is underlined): Sec. 70-73. - Two-story structures. (a) In order to limit the construction of bulkier homes with full second stories in districts with small to medium lot sizes, the following restrictions shall be used: Gulf Stream Core Ocean West Beachfront North/South Place au Soleil Maximum 70.50 x first _70 x first floor _70 x first floor 70.50 x first floor770.50 x first Second floor area area area floor Floor area area Area (b) The use of architectural design features to provide variation among two-story single family homes is required. One or more of the following features shall be incorporated within facades facing public or private roadways on any new two-story, single family home in all zoning districts. • Second -story setback (minimum five feet setback, in addition to ground level front setback) • Front porch (minimum eight feet depth) • Balcony (minimum 24 square feet) • Arcade The town commission may waive this requirement within subsection (b) if the applicant can demonstrate that these features are inconsistent with the home's architectural style and that the desired visual variation is provided through other measures. (c) New construction of a second floor for a single family house within the Gulf Stream Core, North/South and Place Au Soleil zoning districts shall include additional side setbacks for the second -story portion of the building. The second story shall be setback from each first -story side elevation a minimum of 15% of the width of the first story of the house. For example, for a 70 -foot wide home the second story is required to be setback a minimum of 10.5 feet (70 -foot first story width x 15%= 10.5 feet) from each first floor side building elevation Section 3. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 70, Gulf Stream Design Manual, Article IV, Site Development Regulations, Section 70-74, Setbacks, to read as follows (added language is underlined): Sec. 70-74. - Setbacks. (a) Minimum building setbacks. The following table provides the minimum setback requirements for principal and minor accessory structures. Those accessory structures not defined as "minor" shall meet the same setbacks as principal structures. Additional setback requirements apply to the second story portions of single family homes within the Gulf Stream Core, North/South and Place Au Soleil zoning districts (Please see Section 70-73). Section 4. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 3. Repeal of Ordinances in Conflict. All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 4. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. Section 5. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law.
