HomeMy Public PortalAbout16024 - Valley Sanitary Relief Phase III (13444)OR DINANC E NO. 16024 AN ORDINANCE, declaring the necessity for the acquisition of easements and temporary easements in certain real property within The Metropolitan St. Louis Sewer District for the purpose of construction of sewers and related appurtenances in the project known as Valley Sanitary Relief Phase III (13444) in Cities of Ballwin and Clarkson Valley, Missouri to serve the needs of residents of the area, and authorizing staff to proceed with further condemnation efforts related to the project, including but not limited to the purchase and/or the filing of all necessary court pleadings or documents to commence and prosecute formal legal proceedings for the acquisition of said easements and temporary construction easements. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an areas of Ballwin and Clarkson Valley, Missouri within the Caulks Creek Watershed wherein live and work numerous people; and WHEREAS, sewage gathered from such area will have no adequate means of disposition, and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health and welfare by construction, reconstruction, maintenance or repair of sewers and related appurtenances on, over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise easements and temporary construction easements in real property for the construction of sewers and related appurtenances in the project known as Valley Sanitary Relief Phase III (13444) hereinafter set forth, said easements being more particularly described below: PARCEL #1 A 10 FOOT WIDE SEWER EASEMENT across a tract of land being all of Lot 58 of “Williamsburg Green Plat No. 1” as recorded in Plat Book 179, Pages 78 and 79 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: COMMENCING at the Southwest corner of said Lot 58 of “Williamsburg Green Plat No. 1”, said point also being the East line of Clarkson Road (Variable Width); THENCE along the West line of said Lot 58, North 23 degrees 58 minutes 56 seconds East, 100.67 feet to the ACTUAL POINT OF BEGINNING of the centerline of said 10 FOOT WIDE SEWER EASEMENT; THENCE leaving the West line of said Lot 58, South 21 degrees 01 minutes 04 seconds East, 34.66 feet to the POINT OF TERMINUS of the centerline of said 10 FOOT WIDE SEWER EASEMENT, also being on the West line of an existing 10 foot wide easement recorded in Plat Book 179, Page 78 of the St. Louis County, Missouri Recorder’s Office. PARCEL #6 A VARIABLE WIDTH SEWER EASEMENT across a tract of land being all of Lot 77 of “Whispering Oakwood Plat No. 5”, as recorded in Plat Book 149, Page 60 of the St. Louis County, Missouri Recorder’s Office, being more particularly described as follows: COMMENCING at the Southeast corner of said Lot 77 of “Whispering Oakwood Plat No. 5”, also being the North line of Del Ebro Drive (50 foot wide); THENCE along the South line of said Lot 77, South 89 degrees 57 minutes 03 seconds West, 29.24 feet to the point of a curve concave to the Northeast; THENCE along said curve having a radius of 100.00 feet, an arc length of 115.43 feet and a chord bearing of North 56 degrees 58 minutes 55 seconds West, 109.13 feet to the ACTUAL POINT OF BEGINNING of the herein described VARIABLE WIDTH SEWER EASEMENT; THENCE continuing along the South line of said Lot 77, also being the East line of Golfview Drive (50 foot wide), a curve concave to the Northeast having a radius of 100.00 feet, an arc length of 20.85 feet, and a chord bearing of North 17 degrees 56 minutes 30 seconds West, 20.81 feet to the East line of an existing 5 foot wide water easement to St. Louis County as recorded in Plat Book 149, Page 60 of the St. Louis County, Missouri Recorder’s Office; THENCE leaving the South line of said Lot 77, North 06 degrees 13 minutes 33 seconds East, 0.88 feet along the East line of said 5 foot wide water easement; THENCE leaving the East line of said 5 foot wide water easement, South 29 degrees 27 minutes 46 seconds East, 28.49 feet to the North line of an existing variable width utility easement as recorded in Plat Book 149, Page 60 of the St. Louis County, Missouri Recorder’s Office; THENCE along the North line of said variable width utility easement, North 61 degrees 45 minutes 36 seconds West, 8.74 feet to the POINT OF BEGINNING. VARIABLE WIDTH TEMPORARY CONSTRUCTION EASEMENTS will become null and void upon completion of the above described sewer construction. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to enter into contracts to acquire by purchase to the extent possible or to continue with the condemnation process by preparing and/or filing all necessary court pleadings and documents to institute and prosecute legal actions in condemnation to acquire all easements for the above-referenced project, pursuant to the provisions of the Charter of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri for the appropriation of private property rights as hereinabove set out. The foregoing Ordinance was adopted on December 8, 2022.
