RESOLUTION GRANTING AN AMENDED
CONDITIONAL USE PERMIT TO
KENNETH DOBOSZENSKI AND PHYLLLS DOBOSZENSKI
DBA DANNY'S CATERING
WHEREAS, Kenneth Doboszenski and Phyllis Doboszenski, dba Danny's
Catering (Applicants) have been granted a conditional use permit to operate a
bakery, restaurant and catering business at 4425 T.I. 55 by resolution no. 88-13
dated March 15, 1988; and
WHEREAS, the Applicants have applied for an amendment to their
conditional use permit to allow a 16' X 16' cooler room addition; and
WHEREAS, this matter has been reviewed by the planning commission on
July 11, 1989, and by the City Council on August 1, 1989; and
WHEREAS, it has been determined that granting an amended conditional use
permit will not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that an amended conditional use permit be granted to the
Applicants for the stated purpose, subject to the following terms and conditions:
1. There shall be no exterior storage on the site;
2. The exterior building materials of the existing structure shall remain
unchanged and the proposed additional shall comply with all city
requirements;
3. The sign shall be as proposed by the Applicants and shall meet city code;
4. The exterior trash container shall be screened from view with materials
which are compatible with those used on the exterior of the principal
structure;
5. The Applicants shall install landscaping as required by the city's ordinance,
shall work with staff regarding the type and location of the landscaping, and
shall make a cash deposit to the City of $400 to ensure completion of the
landscaping;
6. Hardsurface coverage shall not exceed the 60/40 ratio as shown on the plan
submitted the City;
7. The hours of operation may extend to 24 hours per day, 7 days per week;
8. The number of employees shall not exceed 12;
9. Exterior lighting shall be installed in accordance with the plans submitted to
the City and shall be designed so as not to broadcast light off of the site;
10. The cooler room addition to be built on the building shall not exceed 16' X
16';
11. The on -site septic system and drainfield shall be subject to approval by city
staff;
12. All food handling operations shall be approved and licensed by Hennepin
county;
13. The Applicants shall utilize grease traps in the kitchen and low water use
toilets as required by city staff;
14. The Applicants shall screen all rooftop mechanical equipment to the
satisfaction of city staff, including the equipment located on top of the
cooler room addition which shall be screened by a parapet on top of the
north wall or by increasing the pitch of the roof;
15. There shall be no overnight parking of vehicles on site;
16. The existing shed must meet city setback requirements from the principal
building and all property lines;
17. The Applicants shall comply with all plans and drawings submitted to the
City and upon which City review has been conducted;
18. The Applicants shall pay to the City a fee in the amount determined by the
staff to represent the actual cost to the City of reviewing this conditional
use permit application; and
19. The Applicants shall dedicate to the City the right-of-way for County Road
19 and T.H. 55 as determined by the city engineer; and
20. Any violation of the terms and conditions of this conditional use permit or
of any related section of the City's ordinance code shall be grounds for
revocation of this conditional use permit.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the City Council of
the City of Medina, that Resolution No. 88-13 is hereby revoked.
