The Council of Bal Harbour Village met Tuesday, December 9,
1980 at 9:30 A. M. in the Village Hall.
Present: Miss Gray and Messrs. Beatty, Krez, Printup and
Taplin
Also present were Fred W. Maley, Village Manager; Mary T.
Wetterer, Village Clerk; and Alan T. Dimond, representing
the Village Attorney.
On motion of Mr. Beatty, seconded by Mr. Krez and voted
the minutes of November 25, 1980 were approved as submitted.
Mr. Herb Kaplan of the Sheraton Bal Harbour and Mr. Williams
of American Sightseeing Company discussed with the counci]. the
problem of sightseeing busses parking on Collins Avenue and some
possible solutions to the problem. It was moved by Mr. Beatty,
seconded by Mr. Taplin and voted the hotel and sightseeing company
be given until the next meeting on January 27th to come up with
a solution.
Mr. Maley reported that Mr. Gold has filed an appeal of the
Dade County Zoning Board of Appeals' decision to allow a permanent
heliport at Bakers Haulover Park. On motion of Mr. Taplin, seconded
by Miss Gray and voted Mr. Maley was authorized to hire experts
to conduct noi>e tests of beachfront helicopter operations in pre-
paration for the appeal.
Mr. Maley said there have been several inquiries from cable
television companies regarding applying for a franchise to serve
Bal Harbour, including Ultra-Com who had originally shown interest
in serving the Village. On motion of Mr. Taplin, seconded by
Mr. Beatty and voted Mr. Maley was authorized to advertise for bids
for cable television franchises. The council also discussed the
operation of "Home Box Office" in the village and requested the
village attorney to see if these services should be regulated by
the village.
On motion of Mr. Taplin, seconded by Miss Gray and voted
Mayor Printup was authorized to sign the matching fund advertising
contracts for our hotels and restaurants as provided for in the
1981 Tourism Department advertising budget.
The Council discussed the appearance of the exterior of the
oceanfront buildings and discussed the possibility of passing an
ordinance governing use of storm shutters and other features. It
was moved by Mr. Taplin, seconded by Mr. Beatty and voted that an
architectural firm be hired to review the shutter problem. Also
discussed was the advisibility of setting up an architectural re-
view board for Collins Avenue properties.
Mr. Maley said he had discussed with Dade County Fire
Department their programs regarding building inspections and hold-
ing fire drills and giving lectures to building residents. He
said he is preparing a letter to various buildings. It was sug-
gested that the chairman of the Tenant's Associations invite the
fire department to lecture at their buildings.
Mr. Krez said he had received many complaints on the in-
terruption of telephone service to the residents for long periods.
It was moved by Mr. Krez, seconded by Mr. Beatty and voted
that the Mayor should send a letter to the President of Southern
Be11 Telephone protesting the poor telephone service to the
residents.
The council discussed the delay in completing the reno-
vations to the village hall due to the omission of a penalty
clause in the contract. It was moved by Mr. Krez that any
contract over $25,000 be submitted to the Mayor or Assistant
Mayor for checking. The motion died for a lack of a second.
Mr. Maley reported that the street light contract has
been delayed due to the failure of the supplier to deliver the
custom made brackets. He said that the contract penalty will
start after December 17th and he believes that the contractor
will ask for a time extension due to the fixture brackets not
being received.
The Village Manager said that Mr. Howard Branston will be
in town tomorrow to discuss the highway, sidewalk, and the
center landscaping lighting for Collins Avenue. He said his
fee for presenting several alternative plans will be $2,750
and for an additional $1,000 he will study 96th St. also in
the initial scheme. His total fee for this project will be
approximately $8,500, plus expenses. It was moved by Mr. Taplin,
seconded by Mr. Beatty and voted that Mr. Branston be retain-
ed to work with Stinson and Martinez, the local engineering
contractor to prepare lighting plans for Coll.insa Avenue and
96th Street.
Mr. Maley said that a suggestion was made at the last
meeting regarding additional police. Chief Staubesand ex-
plained a survey he had made showing man hours for the pre-
vious years, and hours needed after the addition to the Bal
Harbour Shops is completed. The Chief said that at present
he could use a civilian to take reports and do follow up so
that police officers could be on active duty. It was moved
by Mr. Beatty, seconded by Mr. Taplin and voted that a public
service aid be hired for the police department. It was moved
by Mr. Taplin, seconded by Miss Gray and voted that Mr. Maley
get prices on an outside police consultant and bring it up at
the next meeting.
Mr. Krez left the meeting at this point and was not
present for any of the following items.
Miss Gray said that an alarm from one of the Bat Harbour
Shops had rung all day Sunday. Mr. Maley said he would see
if an ordinance could be drafted covering shut off systems on
alarms.
On the alternate savings benefit plan for key employees,
the council felt that they did not care to institute a plan
for all employees named, but only the Manager. It was moved

by Mr. Beatty, seconded by Mr. Taplin and voted that Mr,
Maley would get a statement from Mr. Gold on the legality
of this idea.
Mr. Maley was excused from the meeting and on motion of
Mr. Taplin, seconded by Mr. Beatty and voted the Manager was
granted a $1.000 Christmas bonus as he does not share in the
employees fund contributed by the residents.
On motion of Mr. Beatty, seconded by Mr. Taplin the
meeting was adjourned at 11:25 A.M.

The Council of Bal Harbour Village met Tuesday, January 27,
1981 at 9:30 A.M. in the Village Hall.,
Present: Miss Gray and Messrs.. Beatty, Krez, Printup and Taplin
Also present were Fred W, Maley, Village Manager; Mary T. Wetterer,
Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Mr. Beatty, seconded by Mr. Krez and voted the
minutes of the meeting of December 9, 1980 were approved as
submitted.
Mr. Herb Kaplan of the Sheraton Hotel explained that they have
assigned personnel to expedite the movement of sightseeing busses
on Collins Avenue and have received a letter from the Balmoral
Condominium Association thanking them for resolving the problem.
Mr. Gold reported that the Dade County Commission has voted
in favor of our appeal, and overturned the Zoning Board's decision
to a llow a heliport at Bakers Haulover, therefor, he does not be-
lieve there will be a hearing by the State Department of Trans-
portation. The council did not deem it necessary to proceed with
a noise survey at this time.
Mr. Gold said he had discussed the alternate savings plan
benefit with Mr. Maley and that he would be concerned about it
being retroactive. The plan Mr. Maley has for a future arrange-
ment has his approval and that it would be a policy matter of
Council. Mr. Maley was instructed to get costs for the council
on the plan to provide him with a minimum termination benefit of
$3 for every $1 he has contributed to the retirement plan.
