S< - 3 RESOLUTION GRANTING FINAL APPROVAL OF INDEPENDENCE ESTATES 2ND ADDITION WHEREAS, Dan -Bar Homes, Inc. (Applicant) has requested approval to subdivide land according to the plat of Independence Estates 2nd Addition submitted to the City; and WHEREAS, the planning commission and city council have reviewed the plat submitted by the Applicant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that final approval is granted to the Applicant for Independence Estates, 2nd Addition, subject to the following conditions: 1. The Applicant shall execute a Development Agreement for construction of the roads, sewers and other public improvements in a form satisfactory to the city attorney; 2. Dedication of Outlot A, Independence Estates, 2nd Addition is accepted for park purposes and satisfies the Applicant's requirements for park dedication for this subdivision and any lots created hereafter through subdivision of Outlot B; 3. The Applicant shall submit to the City as built plans for the streets, sewers and other public improvements constructed by the Applicant in this subdivision and in Independence Estates; 4. The Applicant shall post a performance bond with the City in the amount of $178, 375 to ensure completion of the streets, sewers and other public improvements; 5. Ardmore south of Walnut shall remain a platted street; 6. Walnut east of Aspen to the unnamed road shall be maintained by the Applicant; 7. No building permits shall be issued by the City for construction of houses until the streets have been improved to at least a rock base; 8. The Applicant shall pay sanitary sewer and water connection charges as required by the City prior to the issuance of building permits; 9. The Applicant shall comply with the erosion control plan it has submitted to the City; 10. No more than one driveway, curb cut or entrance shall be permitted on any lot; 11. The Applicant shall pay to the City for administrative expenses the amount determined by the city staff to represent the actual cost to the City of reviewing this subdivision; and 12. The Applicant shall file the final plat of record within 60 days of the date of the adoption of this resolution. Failure to file the final plat within such period of time shall render the City's approval null and void.
