CITY OF MEDINA
RESOLUTION NO. Y% -6-
RESOLUTION GRANTING A
VARIANCE FOR GREG BENNIS
WHEREAS, Greg Bennis (Applicant) has requested a variance to reduce the
front yard setback from 30' to 20' 7" to construct an addition to the garage at 2998
Lakeshore Avenue; and
WHEREAS, Section 825.45 of the City's Code of Ordinances and Minn. Stat.
Section 462.357 require that variances from the strict interpretation of the zoning
ordinance be granted only when there is a demonstrated hardship because of
circumstances unique to the property; and
WHEREAS, the planning commission considered the Applicant's request on
August 8, 1989, and recommend approval thereof; and
WHEREAS, the City Council has had an opportunity to review the matter
and to hear from the Applicant regarding his request.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota that the Applicant's request for a variance to reduce the front
yard setback from 30' to 20' 7" for a garage addition to 2998 Lakeshore Avenue,
subject to the following conditions:
1. The garage addition shall be constructed in accordance with the plans and
specifications submitted to the City;
2. The Applicant shall combine the three lots and the vacated portion of
Spruce Street into a single parcel for tax purposes; and
3. The variance shall be null and void after one year from the date of this
resolution unless the garage addition has been constructed within such
period of time.
3E IT FURTHER RESOLVED by the City Council of the City of Medina that
the hardships justifying the variance are the topography and shape of the
Applicant's property.
