NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council ofthe Borough ofCarteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from CME Associates for engineering services related to the preparation of the Green Acres Major Land Diversion Application for Chrome Park, at a total cost not to exceed $6,000.00 is hereby approved. 2. This action is approved as an award of a professional services contract pursuant to NJ.S.A 40A: 11-5(1 lea) in accordance with the Borough's Fair and Open Process as authorized by law. 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department and CME Associates. It is our understanding that you desire to apply for a Major land Diversion Application from the New Jersey Department of Environmental Protection (NJDEP) Green Acres Program. This application Is required to construct a proposed new middle school within the existing northern limits of Chrome Park. Accordingly, Chrome Park is listed on the Recreation and Open Space Inventory (ROSI) database on file with the New 'Jersey Department of Environmental Protection Green Acres Program. As such, the Borough is required to submit to the Green Acres Program for approval of same, It Is noted that it is the intention of the Borough to submit for an approval of a major diversion 'of unfunded parkland. Based upon information provided to our office regarding preliminary actions taken by the Borough relative to the project, it is noted that the replacement iands considered for the major diversion of parkland application are considered to be the Wa~er B. Overholt Memoriai Stadium at the Carteret High School and a portion of Sullivan Field adjacent to the Carteret Middle School. Boundary Surveys for Chrome Park and the area of Sullivan Fields have been provided to this office by the Borough. A pre-application conference with an NJDEP Green Acres representative, David Smith, local government and municipal consultants was performed on September 26, 2007 by T&M Associates. Also, a scoping hearing, a precursor to the Green Acres pre- application, was held by the governing body on November 29, 2007. Pre-oapplicatlon conference included review of applicable rules, procedures and forms and a visit to parklands applicable to proposed diversion of parkland. o Scoping hearing performed in aCGordance with N.J.A.C. 7:36-26,8. Hearing was held by the governing body adhering to all public notice requirements to solicit public comment on the proposed diversion of parkland and noted alternatives analysis to diversion of parkland. AdditionallY, a stenographic transcript of same has been prepared. . o A generalized alternatives analysis was performed by Farldy Veisz Fraylak, PC dated November 27, 2007. It should be noted that the alternatives review provided to our office does not appear to conform to the requirements set forth in N.J.A.C. 7:36-26.9 and same will be reqUired to be expanded upon for submission of pre-application for major diverslpn of parklands application. . A Boundary and Topographic Survey prepared for Carteret High School, Block 184 Lot 1 was prepared by De Muro Associates and dated December 4, 2000 and last revised September 23, 2006. . . . A Boundary Survey prepared for Chrome Park, 8iock '262 Lots 1 thru 8, Block 263 Lots 1 thru e. Block 264 Lots 1 thru 9 and Slock 265 Lots' 1 thru 8 was prepared by T&M Associates and dated December 5, 2006. . A Boundary Survey prepared tor Cornell Park, Block 371 Lots 152 thru 166 was prepared by Najarian Associates and dated April 1 , 2005. . A Boundary and Topographic Survey prepared for Block 183 Lot 25 was prepared by Najarian Associates and dated January 25, 2005 and last revised March 10, 2005. Accordingly. our office proposes the fOllowing scope of services: PHASE 1- Pre-Application Preoaration This phase of work will include the preparation of the Pre-Application for Major Diversion of Parkland to the Green Acres Program conforming to N.J.A.C. 7:36-26.9. Acres: - Preparation of Attachment J: Environmental Assessment Report - Coordination of Attachment II: Land Valuation l'orm$ - Preparation of Attachment 1II: Preliminary Compensation Proposal for Major Diversion of Parkland - Preparation of Attachment IV: Permit I Approval Checkli$t - Preparation of Attachment V: Map RequJrements and preparation of all reference maps as required This phase will include preparation of a conceptual site plan for the proposed new school location and associated relation of park amenities ana improvements within Chrome Park. Additionally, our office will prepare reference maps, site location maps, relocations maps, and aerial/GIS maps for submission' in support of the pre-application requirements. A list of anticipated outside agency approvals will be prepared for the proposed Chrome Park Improvements. A detailed description of the proposed major land diversion application, '8.compensation statement prepared in 'conjunction with the Borough Tax Assessor, and description of how the project is supporting the goals of the state Development and Redevelopment Plan will also be prepared by this office In accordance with N.J.A.C. 7:36.26. Additionally, our office will review and prepare documents to address tree removal requirements for the' pre-application submission. Conforming to N.J.A.C. 7:36-26.11 (eHi), a second scoping hearing shall be conducted within the Borough upon receipt of notice of application completeness from Green Acres. Our office will. attend and participate in the final application scoping hearing. In conformance wtth appropriate Green Acres submittal time frames, our office will coordinate. and submit the post-hearing submtttal package to Green Acres for .final application. For SUbmission to Green Acres, the Borough shall supply our office with the following' documents: the second scoping hearing resolution issued by the governing body, associated h!laring t~anscrlpts, applicable proofs of publication and any additional supplemental information requested by Green Acres. . This phase will include attendance at two (2) professionai meetings and required coordination with the NJDEP Green Acres Program for submittal of the final'application package and the State House Commission ruling for silme. 'Our office is currently preparing Attachment V: Map Requirements as noted in Phase.1 above. Coordination with the Borough for Attachment II and III will begin immediately upon your' acceptance of this proposal. It is estimated that preliminary application package preparation will take approximately four'(4) weeks to complete. Exceptions - It Is assumed that replacement lands are adequate to meet the market value and quality re;quirements per N.J.A,C. 7:36-26.10. - Required appraisals, surveys and title work for parkland of both diverted and replacement lands described herewith were previously prepared in accordance with the NJDEP Green Acres Program reqUirements and official copies of same will be provided to our office upon request. Deed descriptions should also be provided to our office as required. It is assumed that all surveys as noted above will be provided to this office in digital CAD format for our use In preparation of the Green Acres land diversion applications. - Any required conditions of final Green Acres land diversion approval are not accounted for this proposal <IS Issued by the State House Commission. As such, it is assumed that the submission package and associated Attachment forms coincide with those required for pre-application approval. - The Borough is assumed to be responsible .for preparing and coordination all applicable public notices. . Architectural fees for con~eptual plans are not included in our proposal. . . - The cost of certified mailings for permit applications and costs associated with same are' considered extra and will be invoiced on a lime and eXPense basis. - Geotechnical services are not required and are therefore not included' in this proposal. - Any environmental permitting, report preparation or remediation beyond the scope outline.d above will be considered extra. Said fees will be based on the hourly rate or a 'fixed fee mutually agreed upon writing. - f}pplic.ation fees are can'sidered eXI;a and will be requested at the time of submission. - The above-quoted fees will be in effect for a period of twelve (12) months from the date of this proposal; however. the fees on the hourly rat!l SChedule are subject to change by January 1 of each year'.
