HomeMy Public PortalAbout1989-72Member 54-1 rr adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO. 5.2`7 � RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO JOHN DAY FOR 780-790 TOWER DRIVE WHEREAS, John Day (Applicant) has applied for a conditional use permit to construct an office warehouse at 780-790 Tower Drive, which property is legally described as Lots 3 and 4, Block 1, Medina Industrial Addition; and WHEREAS, the City's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, this matter has been reviewed by the planning commission on September 12, 1989, and by the City Council on October 3, 1989; and WHEREAS, it has been determined that construction of the proposed office - warehouse will not impede the orderly development of adjacent properties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that a conditional use permit be granted to the Applicants for the stated purpose, subject to the following terms and conditions: 1. The portion of Lot 4 which is not developed shall be graded and seeded and shall not be graveled; 2. The island shall be completed, bermed, curbing to stop at the end of the bituminous surface; 3. Landscaping on the west and north shall be completed as far as the first building is completed and shall be subject to staff review; 4. There shall be no outside storage on the site; 5. All exterior building materials shall meet city code requirements; 6. All signs shall comply with city ordinances and shall be reviewed by staff; 7. Parking spaces 1-8 shall be completed as shown on the site plan submitted to the city; 8. There shall be no exterior storage of trash containers on site; 9. All outside and rooftop mechanical equipment shall be screened from view from adjacent properties or roadways; 10. Complete site plans, including plans for grading and drainage, shall be submitted to the city council for review; 11. The loading area shall be paved with a bituminous surface to a 9-ton capacity and shall be reviewed by city staff. The Applicant shall also submit to the City a letter indicating approval of the parking area by the Elm Creek watershed district; 12. Hours of operation shall be limited to 6 a.m. to 10 p.m., Monday through Saturday; 13. The number of employees shall not exceed eight; 14. Outside lighting shall be designed and installed so as not to cast light directly onto adjacent properties or roadways; 15. The site shall be graded so as to comply with the requirements of the city engineer; 16. The Applicant acknowledges that at some time in the future it may be necessary for the City to construct storm improvements in the area and to assess some or all of the cost thereof against benefitted properites, including the subject property; 17. Lots 3 and 4 shall be combined; 18. The Applicant acknowledges that the building addition cannot be any larger than 4320 square feet; 19. The Applicant shall execute a development agreement with the City in a form satisfactory to the city attorney; 20. The Applicant shall submit to the City a letter of credit in the amount of $25,710 to ensure completion of the required work; 21. The Applicant shall pay to the City a fee in the amount determined by the staff to represent the actual cost to the City of reviewing this conditional use permit application; and 22. The violation of any term or condition of this conditional use permit shall be deemed to be a violation of the city is zoning ordinance and shall be grounds for revocation of the conditional use permit. 2 BE IT FURTHER RESOLVED by the City Council of the City of Medina, that variances shall be granted to the Applicant to reduce the required rear yard setback from 30' to 15' and the required side yard setbacks on both sides from 30' to 15' in order to construct the proposed building on Lots 3 and 4, Block 1, Medina Industrial Addition on the grounds that there exists a hardship because of the size and shape of the lots and because the variances are consistent with others which have been granted in the vicinity.
