RESOLUTION GRANTING AN AMENDED
CONDITIONAL USE PERMIT TO
LORETTO TOWING
WHEREAS, Loretto Towing (Applicant) was granted a conditional use permit
for a towing and automotive repair business located at 4775 Co. Rd. 19 on October
6,1987; and
WHEREAS, the Applicant has applied for an amended conditional use permit
to modify some of the conditions imposed by the City at that time; and
WHEREAS, this matter has been reviewed by the planning commission on
June 13, 1989, and by the City Council on July 5, 1989; and
WHEREAS, it has been determined that granting an amended conditional use
permit will not impede the orderly development of adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, '_Minnesota that an amended conditional use permit be granted to the
Applicant, subject to the following terms and conditions:
1. It is acknowledged that the building exterior meets the City's code
requirements;
2. The City and the Applicant recognize the existence of the current radio
antenna tower at its present height if it meets standards for tie downs and
grounding but any new or rebuilt antenna must meet all codes in effect at
the time of construction or repair;
3. The Applicant shall install all required landscaping to the satisfaction of the
city staff. The Applicant shall give the City a letter of credit in the amount
of $3,000 to ensure that the landscaping is installed and maintained. The
letter of credit shall be kept until June 30, 1990;
4. It is acknowledged that the above ground storage tanks have been removed
from the property;
5. The Applicant shall move the fence to ensure that it is entirely on
Applicant's property or he shall obtain an easement for the fence from the
adjacent property owner;
6. Any security animals maintained on site shall be kept inside the building at
night and during the day in a kennel measuring at least 6 X 6 X 20 with a
roof and concrete floor;
7. The Applicant shall move the trash container to the rear of the building and
screen it to the satisfaction of the zoning administrator;
8. All supplies and materials shall be stored in the fenced area or within the
building;
9. The Applicant may keep no more than eight vehicles outside the fenced area
overnight. The vehicles may be either cars or pick-up trucks and shall be
parked in front of the front line of the building. The vehicles parked outside
overnight may only be ones being dropped off or picked up by customers. No
vehicle may be left outside for more than one night;
10. The existing exterior lighting is hereby approved;
11. All signs shall remain in compliance with city requirements;
12. The Applicant shall maintain current licenses from the appropriate
jurisdictions for the proper and lawful disposal of all waste materials
generated or stored on site;
13. The Applicant shall maintain the exterior of the building in a good state of
repair;
14. The Applicant shall restrict parking on the side of the building to the paved
area. If vehicles are allowed to park on the grass, concrete curbing will be
required;
15. The hours of operation shall be limited to 6:00 a.m. to 9:00 p.m., Monday
through Friday, 6:00 a.m. to 5:00 p.m. on Saturday and 1:00 p.m. to 2:00 p.m.
on Sunday. Emergency towing shall be allowed 24 hours per day;
16. There shall be a maximum of six employees on site at any one time;
17. The Applicant shall convey a 40' easement for roadway purposes along Co.
Rd. 19 unless the Applicant can demonstrate that such an easement
currently exists;
18. The Applicant shall pay to the City a fee in the amount determined by the
staff to represent the actual cost to the City of reviewing this amended
conditional use permit application;
19. Any violation of the terms and conditions of this conditional use permit or
of any city ordinance relating to this property shall be grounds for
revocation of this conditional use permit; and

20. Resolution No. 87-113 granting the original conditional use permit is hereby
rescinded.
