HomeMy Public PortalAbout80-043 (05-06-80)RESOLUTION NO. 80-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD RELATING TO ANNUAL MANDATORY VEHICLE INSPECTION AND MAINTENANCE. WHEREAS, the United States Congress, through passage of the Clean Air Act, has required states to meet ambient air quality standards by 1987; and WHEREAS, federal law provides that the Environmental Protection Agency shall require a periodic inspection and maintenance program for motor vehicles as a part of State Implementation Plans for. Air Quality Management and California is subject to such a requirement; and WHEREAS, the Environmental Protection Agency has interpreted this requirement to mean an annual mandatory vehicle inspection and maintenance program in California; and WHEREAS, the Environmental Protection Agency.is empower- ed to invoke sanctions, both mandatory and discretionary, includ- ing the withholding of federal funds from states not meeting all provisions and deadlines of its requirements; and WHEREAS, federal sanctions are currently in effect in California, denying constructions permits for new industrial facilities emitting 100 tons of pollutants annually; and WHEREAS, the~Environmental Protection Agency has announced it will invoke further sanctions in California by with- holding waster water construction funds and federal highway funds in mid-April; and WHEREAS, the California Legislature has been studying and debating the requirement of an annual mandatory vehicle inspection and maintenance program; and WHEREAS, a pilot vehicle inspection and maintenance program has been underway in the South Coast Air Basin for one year, including the county of Los Angeles, upon transfer of ownership of motor veh"icles; and WHEREAS, no conclusive evidence has yet been offered demonstrating that an annual mandatory vehicle inspection and maintenance program would be cost-effective in achieving ambient air quality standards; and WHEREAS, the annual cost of such a plan to California`s motorists in 1984 would be substantially in excess of $400,000,000; and WHEREAS, such programs require the motorist to have his or her vehicle repaired if the vehicle fails inspection, and has not assured a sufficient number of adequately-trained mechanics nor adequate protection to the motorist from repairs which do not result in the vehicle meeting emission standards; and WHEREAS, the United States Congress is currently consider- ing a measure which would return authority to the states to determine whether a state desires to include within its air quality plan a program of mandatory annual vehicle inspection and maintenance; and WHEREAS, H.R. 6466. by Representatives Satterfield, Stockman and others is currently before the Interstate and Foreign Commerce Subcommittee on Health and Environment in the House of Representatives; and WHEREAS, enactment of H.R. 6466 would provide the California Legislature with additional time within which to properly evaluate the cost-effectiveness of a requirement for mandatory annual vehicle inspection and maintenance; NOW, THEREFORE BE IT RESOLVED, that. the City of Lynwood urges early enactment of H.R. 6466 to insure that California's motorists will not be subjected to an annual mandatory inspection and maintenance program that is not cost-effective nor necessary to assure improvement of the state's air quality; and BE IT FURTHER RESOLVED, that enactment of H.R. 6466 will improve California's economy avoiding inmposition of additional sanctions in California; and eliminating sanctions which are current- ly imposed; and BE IT FURTHER RESOLVED, that copies of this resolution be provided to the House Interstate and Foreign Commerce Committee, to Congressmen David E. Satterfield and Charles H. Wilson and to Senator,Ralph C.. Dills and Assemblyman Frank Vicencia of the California Legislature.
