Home My Public Portal About80-068 (07-15-80) RESOLUTION NO. 80-68 A RESOLUTION OF THE CITY COUNCIL OF THE ,CITY OF LYNWOOD OVERRULING PROTESTS AND ORDERING THE LEVYING OF ANNUAL ASSESSMENTS FOR THE LYNWOOD LANDSCAPE MAINTENANCE DISTRICT FOR FISCAL YEAR 1980-1981 WHEREAS, the City Council of the City of Lynwood did on the 26th day of June, 1980, adopt its Resolution No. 80-60 propos- ing the annual assessment for the Landscape Maintenance Dis- trict and directing the City Engineer to prepare a report in connection therewith, and WHEREAS, the City Engineer did on the 26th day of June, 1980, submit a report in relation to said District pursuant to the provisions of the "Landscaping and Lighting Act of 1972" (Part 2 of Division 15 of the Streets and Highways Code of the State of California), and WHEREAS, the City Council did on the 26th day of June, 1980, adopt Resolution No. 80-61 approving the Engineer's Re- port herein mentioned and declaring its intention to levy and collect assessments within said District and fixing the time and place for a hearing in the matter of said District, and WHEREAS, at its regular meeting of July 1, 1980, the City Council took action to indicate its intention to reduce the amount of the proposed assessments as set forth in the En- gineer's Report to generally not exceed the amount of the as- sessments levied within the said District in fiscal year 1979- 1980, and WHEREAS, in view of the City Council action of July 1, 1980, ~the~Engrieer`s Report has been modified to so reduce the proposed assessments, and WHEREAS, at the time and place specified in said notice the City Council conducted a public hearing and heard and consider- ed any and all oral statements and written protests made and filed by any interested person, NOW, THEREFORE, the City Council of the City of Lynwood DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE as follows: SECTION 1. Each and all of the recitals set forth herein- above are true and correct. SECTION 2. The protests submitted, if ariy, do not repre- sent property owners owning more than 50 percent of the area of assessable lands within said district, and said protests are hereby overruled. SECTION 3. The improvements described in the aforesaid Engineer's Report and Resolution No. 80-61 hereby are ordered to be maintained, and the diagram and assessment set forth in said Report as modified hereby are confirmed. The adoption of this Resolution shall constitute the levying of the assessments in connection therewith for fiscal year 1980-1981. SECTION 4. The City Clerk is hereby authorized and direct- ed to forthwith file a certified copy of said diagram and as- sessment as modified with the County Auditor. SECTION 5.. The City Clerk is hereby further authorized and directed to file a statement as described in the Government Code Section 54900 and following with the County Assessor im- mediately after the adoption of this resolution.
