HomeMy Public PortalAbout1989-79Member adoption: introduced the following resolution and moved its CITY OF MEDINA RESOLUTION NO.; - 79 RESOLUTION GRANTING A VARIANCE FOR BRUCE WHITEHEAD WHEREAS, Bruce Whitehead (Applicant) has requested a variance to reduce the required side yard setback from 10 feet to 2 feet for an addition to the house at 3045 Lakeshore Avenue; and WHEREAS, Section 825.45 of the City's Code of Ordinances and 'Minn. Stat. Section 462.357 require that variances from the strict interpretation of the zoning ordinance be granted only when there is a demonstrated hardship because of circumstances unique to the property; and WHEREAS, the City Council has had an opportunity to review the matter and to hear from the Applicant regarding his request. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that the Applicant's request for a variance is granted, subject to the following conditions: 1. The addition shall be constructed in substantial accordance with the plans and specifications submitted to the City by the Applicant; 2. The accessory structure located along the southeast property line shall be removed from the site prior to issuance of the certificate of occupancy of the new addition; 3. The Applicant shall pay to the City a fee in an amount necessary to reimburse the City for the expense of reviewing this application; and 4. Violation of any of the terms and conditions of this resolution shall be deemed violations of the Medina code of ordinances and shall be grounds for revocation of the variance. BE IT FURTHER RESOLVED by the City Council of the City of Medina that the grounds for granting the variance is that a hardship exists on the property due to its size, the location of the existing building on the lot and because there is precedence to allowing construction within 2 feet of a side lot line when the adjacent property is used for public access.
