'- RESOLUTION GRANTING FINAL APPROVAL OF TUCKBOROUGH FARM FOR PETER KELLY WHEREAS, Peter Kelly (Applicant) has requested final approval of the plat of Tuckborough Farm; and WHEREAS, the city council has reviewed the final plat submitted by the Applicant and compared it with the preliminary plat approved on November 21, 1989. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, Minnesota that final approval is granted to the Applicant for Tuckborough Farm, subject to the following conditions: 1. The Applicant shall prepare a "ghost plat" showing a possible plan for future subdivision if sewer becomes available to the area; 2. Outlots A and B shall be combined with property to the west in the future and cannot be developed until that time; 3. The Applicant shall dedicate a 15 foot wide easement for trail purposes along the northern edge of the subdivision; 4. Carriage Drive shall be continued down to the new alignment of Navajo and the City shall obtain an easement across the 24.5 foot strip of land owned by WCCO; 5. The Applicant shall pay park dedication fees for all lots in an amount to be determined by city staff; 6. It is acknowledged that Lots 1 and 4, Block 1 and Lots 1 and 4, Block 2 can support animal structures; 7. The Applicant shall construct the road to city specifications; 8. The Applicant shall execute easements, covenants and restrictions in a form satisfactory to the city attorney providing for the future construction of a road on Lot 1, Block 2; 9. The Applicant shall execute a development agreement in a form satisfactory to the city attorney to ensure completion of the required work; 10. The Applicant shall pay to the city for administrative expenses the amount determined by the city staff to represent the actual cost to the city of reviewing the subdivision; 11. The Applicant shall file the plat with Hennepin county within 60 days of the date of signature of the plat by the mayor and clerk -treasurer. If the plat is not filed with Hennepin county within such period of time, the City's approval of the plat shall be deemed null and void.
